I made a prior year contribution to my HSA to max out the space that I had left. However, Fidelity does not re-issue an updated 1099 until May 31 if you made a prior year contribution. Can I still file and take the deduction as I know the additional amount to deduct, or should I wait until the updated 1099s come in (and thus having to file an extension)?

If you are sure certain that Fidelity recorded it in the correct year, and you have documentation of the deposit, I'd file now. IRS doesn't start matching up stuff until the fall, and that will be well after the updated form is sent.
