Former LSU defensive coordinator John Chavis is suing the school claiming he and his new employer, Texas A&M, do not owe a buyout that LSU is requesting from his previous contract.

Advocate BR

Total tool move.

The contract ended Dec. 31, 2015. Chavis’ original three-year deal ended Dec. 31, 2014, but he signed a memorandum agreement extending the deal by a year through the 2015 season.

Lawyers of the OT, I believe this screws him. Correct?

This is also on the Rant, so I will copy what I posted there:

If you were ever so lucky to be as in demand as Chavis and in your new contract with your new employer it says that your new employer will indemnify you in the event that your previous employer sues you for liquidated damages, you would absolutely sue your new employer and your old employer in a declaratory judgment action to have a judge tell either your old employer it is not entitled to the liquidated damages or to tell your new employer that it is required to pay those liquidated damages.

This is a non-issue made into an issue by people with no understanding of the law or, apparently, employment.

ETA: I also think, as said on the Rant (oddly enough), that this is a smart venue maneuver by Chavis' attorney, preempting a filing by LSU in EBR Parish and instead fighting on Aggie homeland, Brazos County.

Why is trying to see if you can get out of paying $400,000 a tool move? He probably won't win, but it doesn't hurt to try. Now I could see leaving in the first place being a tool move though.

I understand what you are saying but its seems to be a pretty clear cut issue with him agreeing to a contract extention.

He is not being a man about it and neither is his employer.

I don't really see it as an indictment against him so much as against A&M, unless they have some actual legal basis to contest the provision in Chavis' current contract wherein A&M agreed to indemnify him in the event LSU sought to enforce the liquidated damages clause. $400,000 is a shite ton of money, even to Chavis. The only party, at least with the "facts" as we know them, that is being shitty is A&M, imo.
