Lawyers of the OT--Bike hit my car...left note now might not pay...what to do?

Ok, wife's TWO FREAKIN' WEEK OLD car is legally parked on the street in front of her school along with the rest of the teachers. Comes out to find a note on the windshield with a guy's name, address, phone #. She calls, he admits fault but he's in ER getting hand stitched as he "lost control" of his bike (probably on his cell) and smashed into her new car--hand went through rear light and two long scratches on rear fender.

At first, very nice. whatever he needs to do. Now he's saying he'd prefer not to pay deductible for our insurance and would rather fix light himself and those scratches MAY HAVE BEEN THERE ALREADY FOR ALL HE KNOWS!

The kid is 18 y/o, in New Orleans for Mardi Gras, and his home address is one of the swankiest towns in the U.S. I found him and his parents online. He's saying he doesn't have the money to do more than he's offering.

PISSING ME OFF!

Questiong:

--I'm considering small claims court just out of spite--he's really responsible for the entire amount but we're letting him off easy asking for the deductible. Good idea?

--He's 18 y/o--if he's still a dependent of his parents do they assume any liability?

I was serious before.

If his wife's car was hanging in the street or bike path at all, she could be held responsible.

Not much use now but next time call the police immediately upon finding the note and at least get a report written up.

Get the car repaired and take him to small claims court.

Bit of a PITA but between the light and some paintowrk it could be as much as $1k in repairs.

I certainly wouldn't get your insurance company involved unless the repairs are much more than above. Your rates WILL go up if you make a claim and for such a small amount you're much better off repairing yourself and trying to get the money from the guy.

My $.02 and worth what you paid.

This is going to come down to:

What is your time worth
How much do you value the principle of the matter?

Because financially, going after him in court will be expensive and/or time consuming. Is that worth the light repair and scratches?

I would threaten to sue and ask him to cover the full cost of repairs. Don't go through insurance.

She was parked in line like all of these cars--in fact, this is the exact street it took place. She was actually up on the curb a bit more so than many of these cars.
