Fwiw I didn't think sam smith's song sounded like Tom petty's.
With as much music that gets created around the world its no surprise people write songs that sound somewhat similar. There are only so many chord progressions you can come up with. Should a blues artist have to credit every artist that used the 12 bar i-iv-v progressions before him?

smith had a similar melody to petty, that's why it was even an issue.

There's just nothing that hasn't been done chord progression/melody wise. Everything is going to sound like something else.
There's no limitations in lyrics, that's why copying someone else's words is a far greater crime imo.
