Criteria:
Interesting back story
3-dminesional/ dynamic
Interesting situations
Played by a good actor/actress
Doesn't have to sway towards good or evil

Heck, it could even be in a book.

For me it was Severus Snape. Now I think it's becoming Tyrion Lannister.

Magneto in all of the X-Men movies

Fassbender and McKellen have played him amazingly

He's one of the most well rounded and deep characters in any comic book movie to date

I always tell people that in my opinion that Alan Rickman as Snape must be one of the greatest casting jobs I've ever seen. The "is Snape good or evil?" was a great subplot in both the book and the movies and the ultimate reveal was also great.

I'd also go with Dexter, at least for the first couple of seasons when he was socially awkward and had to force himself to "act normal" so people wouldn't sniff him out (except Sgt. Doax)

William H Macy in Shameless. He plays drunk dad perfectly.

I havent seen that one, but William H. Macy in Fargo is one of the most underrated performances of all time. He was robbed of the oscar. Great character. Great performance.
