I already moved half of my stuff that I don't use into my friend's apartment and it's in there. He's gone on vacation for Christmas.

One thing to keep in mind that many a time they have provisions in rental leases that they can't actually hold you to even if you signed in good faith.


If he is deflecting you with "Well, might as well not bother because I put language in there to close every loophole," the odds of illegal provisions is pretty much pegged at 100%

So... If you had just paid the penalty in the first place you would already be done ? Instead you have now paid the $2700 plus another month ?

The penalty is often on top of rent charges for the remaining leased term (that the apartment goes unoccupied).

I've been living in the apartment, so it's not like it's been money down the drain. I would have had to pay rent anyways somewhere. When I told them to make my apartment available, they told me that they get calls almost every day on 1 bedroom apartments and would be absolutely shocked if mine lasted an entire month. So it didn't seem like it was going to be a big deal at first.

How do you tell the difference between ones they can hold you to and ones that they can't hold you to?

This. I've gotten out of a lease this way. Of course, in my situation the mold was actually a big concern as I contracted meningitis from it and could not continue living there.

There isn't a really defined list. And it will vary from location to location on the laws in place there.


Just saying it's not unheard of for a lease to attempt to remove a tenant's rights that they cannot on the assumption that 1) the renter is oblivious and 2) they won't fight it.


Especially endemic in communities of high turnover like college focused apartments.

Don't know your medical situation, but do you realize that fungal meningitis is very rare and usually exclusively limited to immunocompromised individuals?

I woke up from a 2 day nap at my apartment, stumbled downstairs and called someone and told them I needed to go to the hospital. Had the spinal tap done after a couple days in the hospital. I had a top-floor room and there was a leak in the roof, a quarter of the ceiling was absolutely covered in black mold.

I don't have teh AIDS if that's what you were getting at.

Complain every day about noises, faucets leaks, AC weird noises and lack of hot water... also power surge complaints are nice...... Be nice and don't get huffy. If you do this long enough the apt manager will get approval to allow you to leave at the end of a paid month.

Oh yes... never let them show an apartment without inquiring about issues in your apartment.

Dude, it ain't hard. Don't pay the rent, get served an eviction notice, problem solved. I've lived in half a dozen different apartments plus Meridian Condos and bailed on the majority. All they look at when you apply for an apt is income.
