District court declares Obama immigration action unconstitutional

According to the opinion by Judge Arthur Schwab, the president’s policy goes “beyond prosecutorial discretion” in that it provides a relatively rigid framework for considering applications for deferred action, thus obviating any meaningful case-by-case determination as prosecutorial discretion requires, and provides substantive rights to applicable individuals. As a consequence, Schwab concluded, the action exceeds the scope of executive authority.

We've needed some guidance from the Supreme Court on executive authority for awhile now. I hope this makes its way up and we can get some clear guidelines on where legislation stops and exectuive branch authority begins.

Basically this
Obama's inaction via his executive action is defacto legislation. Executive power, not just wielded by Obama is out of control.

Totally agree.
I would understand "prosecutorial discretion" for 1, 7 or 100 illegal immigrants. But ~5 million?

I was talking in more macro, generic terms than simply his most recent EO on immigration.
I'd certainly say his EO in immigration is pushing the envelope as far as its been pushed in awhile, though.

I know the knee-jerk reaction if you're the average poster on this board is to celebrate, but this thin, poorly-reasoned opinion is going to do more harm than good for you guys. It's not very defensible, legally speaking.

Of course after ruling it un-Constitutional he went ahead and gave the defendant an opportunity to remove his guilty plea and try a defense under the new policies.

Not gonna happen.
When it does make it to the Supremes, the thing in question will be the timing and the vote. If it takes 2 years and the Republicans take over the Presidency, it will be a 9-0 decision LIMITED TO the amnesty executive order. If it makes it up quicker or if a Dem wins the Presidency, the three psychophant c*nts will vote to give the President any and all dictatorial powers he wants. But the CLEARLY unconstitutional amnesty order will go down.
It will also let everyone know who the filthy, corrupt, and intellectually bankrupt judges are on the Federal bench. This one's not even close and should be laughed out of any court in the land.
