Amazon Marketplace Problem

Alright OT,
I purchased an item that retails for $300 on Amazon. The Amazon price was $215. Not an unreal discount, I consider it a typical Amazon discount.
I received it and the item received was a different (cheaper) model than I purchased. The invoice and packing list say the correct model, but I received a model that retails for $230.
So I think, hey, its Amazon - the best customer service in the world. Turns out I purchased from an individual person using Amazon's marketplace and Amazon's limited in what they can do.
The individual says he will refund my money if I ship it back. However, the item is heavy, and will cost me $96 to ship it back. Am I screwed here by either being stuck with a cheaper model or having to pay $96 to get $215 back.
I said this to the seller, and offered a compromise of being refunded the difference in cost and I would keep the item. No dice.

Have you actually tried talking to Amazon about it?
I have always heard that Amazon is really hard on their marketplace sellers.

Could you get Amazon agree to ban this person from using their marketplace for false advertising and poor customer service if they refuse to pay return shipping for you?

Yep. He said it was a clerical error in the listing.
He has only sold 3 things on Amazon ever. I can go back in my order history and see that I did purchase from their "Marketplace" but I didn't realize I was when I was actually making the purchase.
I'm basically dealing with an Ebay seller from New Mexico.

If they sent you the wrong item, they should pay return shipping. End of story. If they refuse, you should file a complaint with amazon pronto. If its anything like ebay, amazon will refund your money and the return shipping cost if you return it since it wasn't your fault.

Absolutely no reason you should pay to ship it back. It was the seller's mistake/deception. Raise hell about it. Make sure amazon hears about all this so they can remove them from the marketplace if they do not fix it.

Call your credit card company and have them cancel the charge, easy!

Contact your credit card company. If they sent you the wrong item and refuse to correct the issue your credit card company will pull back the money. Then the company gets a chance to appeal it, but it sounds like you would get the money or at least force them to pay for the shipping.

I called Amazon initially. There's a protocol for handling it- but it doesn't really help my situation if he gets banned or not. Amazon is willing to force the guy to give me a refund - but the shipping is apparently my responsibility.

I would go back to Amazon and get them to help you. He should pay for shipping because it was his mistake. You shouldn't be out any money.

I don't think its a company. Its just a dude in New Mexico. The credit card charge says AMAZON MARKETPLACE
I thought about that - is that a shitty way to handle it? It sort of forces the hand of someone though.

Shipping is your responsibility when:
1. You ordered the wrong item
2. You no longer need the item/changed your mind
If it was his mistake then shipping is not your responsibility

Well it might ... if the seller uses Amazon consistently to sell products as a major source of income he might be backed against the wall to pay for shipping if he/she can't afford to get banned.
But the credit card company route sounds legit.

In a nutshell, yes. If it were an Amazon purchase, they would go as far as sending a driver to my house to pick it up so I don't have to bend my back. But because its a Marketplace item, they don't require returns to have shipping covered.
Its a wooden kitchen for my daughter. Heavy as frick.

No the current situation is the shitty one. Let the credit card company fight it out for you. They have people paid just for that and they have a lot more leverage than you.
