No, but there would be riots when the motorist isn't charged.

They'd investigate it just like it was a vehicle on pedestrian collision. They'd look at every step the motorist took, whether he was speeding, made an unsafe lane change, yielded, etc., which happens even when pedestrians are walking in the street in the wrong direction. If they find any wrongdoing on the part of the driver, they'll still cite/charge.
