It doesn't matter whether it was a choke hold or not. The only thing that matters was excessive force was used...excessive enough to kill him. It was really unnecessary.

Um, yeah
Then they got on top of him. Pinning him by the neck
homicide plain and simple

I agreed with grand jury in Ferguson....but this was flat out homicide in New York....and I am as far right as can be.

quote:evidently it does since this is the battle cry. shite, look at the title of the OP in the main Garner thread on this very page.

The link I provided explains control of the head in an arresting situation with a struggling perp.

From what I understand, it was not a true 'choke' hold. It was more of what is referred to as a 'seat belt' hold.
The move allows a smaller person to subdue a larger person.
BTW, I read that Garner had been previously arrested EIGHT times, that right, EIGHT times, for the same infraction.

You be the judge. Is that a seatbelt hold? I don't wrap a seatbelt around my neck, but YMMV.

It's a shame this will be viewed through race by both sides
I have ferguson fatigue, Michael brown was a TPOS and I love that Wilson wasn't charged
But this cop belongs in prison. He's a murderer. May not have intent or have premeditated it, but he killed this man and for no reason

Just look at the sensational title in the main Garner thread. Look at it. It's right there for everyone to see. Choke hold.

This was clearly not a homicide, but could very well have been some other form of wrongful killing that doesn't involve premeditated intent to kill.

Seriously, how did the grand jury let the cops walk on that? Who gives an eff if the guys is out there making a few bucks on the side selling cigarettes? Why were the cops even fooling with the guy? What, all the jaywalkers are already locked up?

Did I ever say it was a seat belt hold?

Call it whatever the frick you want. It killed him. I'm not sure what semantic bullshite that is that comforts you. A dude is dead because of the action of the cop. Parsing the name of the action is ridiculous.

If he didn't premeditate it, then he's not a murderer.
We have a serious problem in this country of laypersons becoming enraged that people aren't charged with crimes they themselves can't even define.
This cop went way over the top. He should be fired at minimum and charged with something or more than one thing at maximum. But none of those things should be murder.

More of a headlock. He wasn't getting choked out. I don't agree with the way it went down but he's not the first fat guy to die of something like this. I wouldn't have convicted the cop of a crime.

Yep. The TM and MB situations are one thing, but if someone is defending the cop on this one, it tells me they will NEVER take the side of the black individual in one of these "race-related" incidents. Makes them just as bad as those on the other side they admonish.

Well what if the hold wasn't the one that was against police policy?

Where's your medical degree from and how many autopsies have you participated in?

What was the cause of death?
re: So was Garner put in a choke hold or not?Posted by the808bass on 12/3/14 at 9:54 pm to meauxjeaux2
Then it just moves the liability squarely and wholly on the department for allowing their officers to subdue suspects with a potentially lethal manuever. And it's still morally wrong.
