I was always under the impression that reckless operation was knowingly and intentionally driving without regard to others on the road. Granted I am no lawyer, but it doesn't seem to me a kid driving with his family in the back seat would be doing that. It's a tragedy all the way around. I just think it's dumb policy to charge every person that gets in an accident with reckless driving.

Obviously some discretion was used when charging him. I think the fact that they threw in a reckless operation ticket just rubs a lot of people the wrong way.

Most people feel they should do a toxicology report, and if he's clean let him be.

It's a ticket that never will end up in court. The DA will most likely drop any charges against this kid.

1. The headline the news chose makes it sound like they are going to throw the kid under the jail.

2. I think this is highly fricked up by the state police. I understand this is a standard ticket but how about we apply some fricking common sense to situations. Do we really need to shake a teen down over an accident that kills his parents?

Who would the state be providing justice to by doing that? His family? Doubt it. The community? Doesn't seem so. Who then?

Honestly he should probably be ticketed with failure to maintain control, but I guess falling asleep had something to do with it.

Not being "emotional" in this case is impossible I would think, for most. ... They just need to leave it alone. ... It was an unintentional, horrific accident. He fell asleep ... Unlike driving under the influence which is absolutely willful.

If so, yes to your question. The DA's office can use discretion in this case.
