do you work for State Farm?
Used to.

If so, why does SF often require a police report to open a claim but needs to talk to the insured before paying a PD claim?
They normally don't require a police report. Actually, they can't require a police report, as sometimes this is not an option. It is preferred to have the report, however.
All insurance companies must talk to their policyholder before moving forward with a claim. That's SOP.
The OP could have filed it under his policy if he was frustrated, then been out his deductible until SF spoke to the other party and reimbursed the OP.

What if their insured died in the accident?

The other driver's statements and admissions to the police officer would be admissible evidence. She would either have to admit to the rear end collision or come up with some other reasonable explanation.

That could overcome the physical evidence on the scene.

Damage to the front of her car and the back of his? Not unless he backed in to her.

For a traffic fatality there would be much more. Even here in AL, that scene would be worked by someone that would be able to completely reconstruct that scene. Skid marks and debris are other variables that would be considered. Traffic homicide investigators get swiped up upon retirement by insurance companies just for this reason. Very hard certification to get here in AL.

Thats what I'm now doing.. Filing it under my policy and hoping I get my deductible reimbursed when the other party decides they don't want to be worthless human beings.
As of today, the claim has been 'escalated' and they sending an agent to their house to get a statement. Not expecting anything though..
What pissed me off is that the kid who hit me was in a Navigator and attended a private school that I know is not cheap... People suck.

Then obviously there would be a police report.

but how could SF talk to their insured? Just playing devil's advocate here...

ALWAYS GET A POLICE REPORT

Find a different insurance company - you pay a premium to be with State Farm, sounds like their agents and claim process sucks...
