I have found that most people would be astounded by some of the things judges get away with on a regular basis in their courtrooms with very very little accountability.

There is the judicial review board but they don't do nearly enough.

Your post illustrates your ignorance of the legal system. It's quite common for judges to "suspend the balance" of a sentence without muddying the record by giving a split sentence. That doesn't mean they didn't take into account the amount of time already served.

In this case, it seems as though she had little time in. I was simply asking as bond information was not in the original article. As for your being infuriated, that's your prerogative. However, it doesn't excuse your behaving like a jackass.

You have no idea how wrong you are, dumbass. I work in the criminal justice system daily. I know how the system works. I work with felons daily. Go smoke some pot and believe in your nonsense.

I appreciate your permission to be a dick to you. I'm tired of so many so-called discussions devoid if common sense.

Worth quite a bit. That's why I asked

It's possible that there were profound mitigating circumstances, or extensive mitigation provided, that swayed the judge. Or he's an idiot. It's hard to say with how little information we have.

Doesn't change the fact that your assertion that a judge that doesn't go through the effort of splitting a sentence didn't take their length of incarceration into account is absurd. Or the fact that I don't smoke pot and you're clutching at ad hominem straws.

I only thought Judge Ware was crap before I read this article. He's a whole lot worse than any description I could come up with.

The original article wasn't clear on when exactly she was sentenced, so it was possible that she had moved after sentencing but before the article ran. You'd be surprised how long it sometimes takes for the media to catch wind of things like this.

That said, the issue has now been cleared up. Sounds like she didn't do much time at all before bonding.

This case was a bench trial. The boyfriend told the cops (on tape) that she did it. During trial he recanted and said he couldn't remember. She was out on bail the entire time and now lives in Florida. The Judge seems to have just wanted her gone without any significant consequences.

Apparently Ware was the director of the Public Defenders office before he was a Judge. That makes a lot of sense now.

I have the utomost respect for what you do. When I file for a Sanity, I know precisely the level of crazy I'm laying on your doorstep. When I said you were ignorant of the legal system, I meant more specifically sentencing, which I imagine you don't witness very often. Trust me when I say that I have clients who have done significant stretches of time, sometimes only months short of the maximum, and the judge will give a sentence that will read as "X years, credit for time served, suspend the balance and place on active supervised probation." It's disingenuous in those situations to claim that the judge didn't "require" jail time. In many of those cases, the judge would have required a split sentence had they not served that chunk of time already. It's just cleaner to do it that way.

Anyway, it sounds like you know far more about this case than I do. Being utterly ignorant, I was asking what I thought was a fairly innocuous question. I wasn't expecting the snark, thus my response

When I inquired about time served prior to sentencing, you responded that the OP was concerned only with the sentence the judge actually handed down. It was a requisite implication, hardly an assumption.

Possibly, but not necessarily. Some of the harshest sentencers I know are former defense attorneys/public defenders.

Sad part is the child isn't even hers. The poor kid is a foster child. Imagine being shuttled from house to house being treated like this? Like being an orphan isn't enough.
