The plaintiff wins his case but only receives .2% of the money awarded.
Granted Warren was a total scumbag, but what if this had been a tort case against Walmart and the same thing happended? Would there be any outrage?

An Alabama man who sued over being hit and kicked by police after leading them on a high-speed chase will get $1,000 in a settlement with the city of Birmingham, while his attorneys will take in $459,000, officials said Wednesday.

Warren is serving a 20-year sentence for attempted murder stemming from his running over a police officer during the chase, in which he also hit a school bus and a patrol car before crashing and being ejected from his vehicle.

Under the terms of the settlement of Warren's 2009 federal suit, in which he accused five Birmingham police officers of excessive force, his attorneys will receive $100,000 for expenses and $359,000 in fees, said Michael Choy, an attorney representing the officers on behalf of the city.

Pretty sure he signed off on the settlement so you play stupid games, you win stupid prizes.

The story is not very informative so we'll have to guess but considering this:
and this
My guess would be the $1000.00 had something to do with him being in prison.

The city settled to avoid further litigation and the risk of a higher payout, Choy said.

I'm wondering if the plantif made a deal with the lawyers to shield the bulk of the settlement from a civil lawsuit with the cop he ran over.

quote:How would that work? Given his circumstances his sole goal may have been to cost the city as much as possible and he didn't care about receiving the money because he can't spend it in prison.

We need Affordable legal reform.

Legal representation is a human right. Not some commodity to sell.
Let's get this idea moving.

Not enough facts to know why this happened or happended.

yeah in LA i don't see how that wouldn't get the lawyer's in some trouble with the ODC, especially since (per the article) 100k went to expenses
typically in the "client got nothing, lawyer got everything" cases, the expenses eat up all the margins

n/m
as somebody on the OT pointed out, this is probably a 1983 action, which, per him/her, allows for attorneys fees

quote:Not even close as a generalization. I've associated with a ton of lawyers professionally (fortunately all for good reasons -- mergers, accounting, business structure, labor planning, trusts) and socially. Outside of personal injury specialists who are often just creepy, and one generalist/labor attorney, every one of them are solid, bright, good folks.

OTOH, our tort system is horrible.
Although a 459-to-1 ratio is obviously unusual, the actual norm in Medical Tort is 54%-to-46%. In winning medmal suits, of every dollar allocated to compensation, 54 cents goes to lawyers, experts, and courts.

Actually it is plaintiffs attorneys who give all of us the right to representation. Otherwise only rich people could sue someone. You don't think that law firm racked up $359 K in expenses over the years they had the case? $100K in fees does not seem over the top. I'm not a lawyer by the way but I have employed them and those numbers hardly seem high. 90 percent of legal cases are companies suing companies - we don't need tort reform because we don't have a problem. What we have are idiots who don't understand that they are passionately against their only means of recourse if their poor arse white middle class self wanted to sue someone.

This is a long time practice in states where plaintiffs can be awarded lawyers fees. It is a terrible incentive for the lawyers.

What we have is an idiot who doesn't understand he is passionately against a means of recourse that would net him the same award at half the cost.
