Would it be justifiable to shoot a police officer if...

If you did nothing wrong at all, and he stopped you and started illegally patting you down after you don't consent to a search, and you push him away to stop him. Then he gets physical with you to arrest you, would you be within your rights to physically fight back?

And if it came to it... shoot him?

Haha, if you shoot a police officer you're getting a Murder 1 charge or you're going to end up dead.

I would say NO.

Somewhere down the line there HAS to be a presumption that these guys are working ON THE SIDE of the law... or the entire system is a waste of time.

He doesn't need a warrant or consent for a pat down if he has "cause for suspicion".

I'm asking in terms of the law... would you have broken a law?

I guess what I'm asking is, if the officer illegally assaults you (which is what an illegal search would be), then isn't he breaking the law?

Don't you have the right as a citizen to defend yourself?

That's why I said "doing nothing wrong at all". Meaning, not doing anything to warrant suspicion.

Cops have no right to search or seize my property unless I'm being charged with a crime. If I am carrying a firearm, which I usually am, I do not need to inform the police. That doesn't make me a tpos.

No. If a non-uniformed cop high on acid serves a no knock warrant on the wrong address (your house) in a different state and you shoot him coming through your door, you're still going to jail and taking out third mortgages to fund your defense. Just how it is.

If a cop is shooting at me, then yes I'll shoot him. That's the only way I would take it that far is if my life is in danger. I know I don't break the law so if a cop tries to shoot me then I will defend myself.
