Claiming money from a hit and run accident.

So I know this isn't directly money related, but the people on this board seem to be pretty knowledgeable so I thought this would be the best place to ask. Several weeks ago my wife was in a hit and run car accident. The police came and she gave them the license plate number so they ran it but nothing came back. Fast forward to last week, we obtained the accident report and all of the information for the driver that hit her is on there (VIN,name, license#,etc). She only had liability so insurance wasn't going to cover it in the first place, but now that we have all of this information they said they would look into it, but we haven't heard anything back. So my question is, if insurance can't help us at all is there anyway we can get money from this guy to pay for the damages? Thanks, sorry for the long post.

meaning your wife?


If the other person has insurance you should find help there. Their liability portion would pay. If they are uninsured you would have no protection if you have UM. But you can always file suit for damages

Your insurance company should not be involved in this situation unless the other driver does not have coverage or is under-insured for the damaged amount.

You should file a claim against the at fault party's insurance policy. They are liable for any damage from the collision.

You should have some property damage coverage that your insurance could pay for

Your insurance can always go after the other guy

If they are insured, handle it with their insurance company. If they aren't insured, assuming you are in Louisiana, hit and run is a criminal offense. I know the East Baton Rouge DA's office is pretty active in billing hit and run files, and demanding restitution if there is any plea/conviction.

They won't chase tens of thousands of dollars in medical bills for you, but they are happy to get you a few thousand to get your car fixed.

1) Why does your wife only have liability? What about the potential medical costs on your wife or any other loved ones from an accident that is not her fault?

2) How much damage was done? Did you file a report?

3) Assuming you only carry liability on your wife's vehicle, which means her well being isn't considered when she's in her vehicle, one can only assume that you also don't have uninsured motorists coverage.

4) Odds are it will take an attorney to recoup any damages from the mishap. See #2 above. IF the attorney is successful in collecting a claim for your minimal insured wife, he will get more than his cut on the judgement which could be several years from now.

Long story short is that often times, the best experience one can have is paid-for experience. Your situation sounds like under insurance and you effectively have no recourse. Make this a learning lesson for all future endeavors.

We've both only ever carried liability. It's not a matter of not considering her well being. It was a financial choice was made while we were in college. She was literally in the accident 3 days after we moved to Baton Rouge to start our careers. She now has full coverage. Thanks for your input though.

If the kid doesn't have insurance I'd be surprised... 2 weeks after the accident his transmission and alternator both blew (maybe from the wreck) and he bough a brand new Hyundai Genesis

what does full coverage mean to you? I hear about full coverage all the time and it really means "state minimum".

You should have UM coverage. What "damages" are you looking to recover? Medicals, property...etc?

I wouldn't back out of my driveway in Louisiana without UM coverage.
