National Archives boss: IRS did not "follow the law" on lost Lerner e-mails

The law states that when records are destroyed or accidentially deleted, the National Archives and Records Administration is to be notified. But of course, nobody told them.

I've been trying to point out the IRS's and Lerner's obligations under the Federal Records Act. It's kind of nice to see a person from the responsible government agency confirm my observations that Lerner has some real legal issues if her emails cannot be produced. Lerner cannot use ignorance of the Federal Records Act, or the IRS policies and procedures for compliance contained in the Internal Revenue Manual, as an excuse for not having printed copies of her emails.

I would like to see Congress question the IRS people who claim that Lerner's computer crashed what are the IRS' procedures for insuring compliance with Federal Records Act when a computer malfunctions? The IRS must have had guidance for its employees to remind them of their obligations to retain records. Get the IRS officer in charge of records for questioning. Will that person testify to personal incompetence?
