"Warning Shot" Law Signed In Florida

Warning Shot Law Signed

What do you think? I personally think it is a very very bad idea. From what I understand, the "inspiration" for the bill Marissa Alexander was completely in the wrong but was punished excessively due to the inflexible 10-20-life law.

Link to Marissa Alexander "being in the wrong"? It was a domestic dispute, and according to the article, she felt threatened. You agree with a possible 60 year sentence for firing a warning shot? I don't.

Is that the woman who left the altercation, got a gun, came back, shot at her domestic partner, missed, got busted and then pled stand your ground?

Not everyone is eager to shoot and kill someone even when threatened. This gives those people protection. This was needed imo.

my concern is this really blurs lines.

I mean, at what point does unnecessary escalation of force separate from drawing a gun/firing in the ground?

I fear this will end up with more people being shot, not less.

She ran into the garage, found a gun in a car and fired a "warning shot" after he said he would kill her.

Prosecutors say the shot hit the wall, not the ceiling, and could have hit Gray or his children. At one point they offered Alexander a plea deal of three years in prison. She turned that down and chose to go to trial.


If she left and got a gun, stand your ground certainly shouldn't apply. I dont agree with 60 years or even an aggravated assault conviction. 5-10 max.

My first thought was somewhat similar to this. It seems like this could be an easy excuse for people to illegally discharge firearms with fewer repercussions.

I could NOT disagree more. If you have the luxury of firing a "warning shot"... your life isn't in danger, and you have no business displaying a firearm.

Bad bill for self defense advocates. Now the question when you have to shoot a thug and end up on the stand will be "Mr. Racist/Bigot/Homophobe, why didn't you fire a warning shot first? My client was such a good boy, surely he would have not hurt you."

I mean that she fired a few shots into the wall very close to her husband (and kids) who were already retreating.

BTW, the husband was living in the house that she illegally entered.

What's worse, getting shot while shooting in the air or killing a thug ?

If you shoot first then fire in the air no one will know which came first.

I agree with this 90%. I am OK with the person displaying the firearm if they feel threatened, but firing a "warning" shot seems more like intimidation to me. As you say, if they have that luxury they can't feel too threatened. I can see homeowners standing on their porch firing "warning shots" at teenagers running through their yards.

Besides the Marissa Alexander case, I can't find any claim by someone firing a "warning shot" who was punished. The 10-20-Life rule seems to be more of the issue here, guaranteeing 20 years for each count of any felony.

IMO that's not a good use for a firearm . Hose works pretty good too!

Joe Biden says he supports this law. For me, doesn't make me any difference. Show me a women brandishing any kind of gun and she won't have time to fire a warning shot. My arse is outta there before she could pull the trigger.
