Sterling''s response brings up some interesting angles.

This thing is definitely ending up in federal court.

Read his response. Sterling alleges the recording violated his constitutional rights under the California constitution and cites some case law that may support it. If the recording falls, it all falls.

I think he'll eventually get voted out, but it's always good to read and consider what the other side is saying,

As people have stated, these situations are in no way as cut and dry as some of y'all think.

It’s facially ludicrous that what Mr. Sterling said in these circumstances could produce the equivalent of a death penalty while Kobe Bryant called a referee a “fricking faqqot” on national television sustaining only a modest $100,000 fine.

Bottom of page 19 touches on the "private association policing it' members" angle that's been widely discussed here.

Top of page 6 where he talks about Kobe's fine, I enjoyed that part.

I'm on page 23. He throws absolutely everybody under the bus when he's making his arbitrary and capricious argument.

He had to respond to the NBA's formal charge by today or I think he would lose the right to contest the charge.

I don't get why he's putting up a fight. His attorney claims that they have received an offer of $2.5 Billion for the team. I don't quite buy that but I do believe Mark Cuban who thinks bidding will surpass $1.5 Billion....He bought the team for what, $12 million? And Forbes said the team was worth less than $600 million this past January. I'd play up the racism thing, keep this team all over the news, and get as much money as possible

And what's ironic about the whole thing is the line of African Americans looking to pay Sterling at least $1 BILLION more than any previous valuation would have suggested

With dudes that rich, it's about the principle.

Power trumps money at that level and being forced to sell is the complete opposite of power.

So what you think? Anything in there that will make it tough for the NBA?

BTW, my favorite part is when he lists previous punishments handed out by the league.

Is this actually in there? I figured if he fought it, this would be brought up... I even mentioned it in one of the many threads on the subject.

Why? It's not a criminal matter. He may be able to sue the crazy count that recorded him but he can't make the other nba owners pretentious not to have heard it.

Ultimately, I guess it depends if the owner's franchise agreement allows the courts to step in.

Obviously we don't know but some people alleged to be "in the know" have said that the commissioner, with 75% of the owners in agreement, has broad latitude to strip a franchise with the ruling being final and not subject to a legal challenge.

He can't win if he can't even get it in the courtroom in the first place. Obviously, Sterling thinks he can and Silver disagrees. We'll see which one is right soon, I guess.
