FCC votes 3-2 in favor of Wheeler's proposal

The Federal Communications Commission today voted 3-2 along party lines to formally propose new "net neutrality" rules that may let Internet service providers charge content companies for faster and more reliable delivery of their traffic to users.
FCC Chairman Tom Wheeler's two fellow Democrats on the five-member commission concurred with Wheeler for a 3-2 vote to advance his proposal and begin formally collecting public comment, though they expressed misgivings about the plan.
Critics worry the rules would create "fast lanes" for companies that pay up and mean slower traffic for others.

Can't this be challenged?
Not exactly "challenged". The FCC will go through the formality of "listening" to the public's opinion.

Now that it's passed, the proposal will move into a 60-day public comment period, followed by 60 more days for response. Senior counsel Gigi Sohn has previously said the agency hopes to have a framework in place by the end of the year.

Comcast, AT&T, Verizon, Cox, Charter, and other major ISPs have been plotting this for years.
They threw money at Obama for years and helped keep him in office. When the time came, they knew exactly who they wanted to lead the FCC - one of their own prized lobbyists. Obama obliged and appointed Wheeler.
Wheeler's just a pawn. The major ISPs run the FCC through Wheeler, and they're now getting exactly what they want.
