what shoul i do

sold our house in 1 day and have to be out by may 1

spent all weekend with our realtor looking at preowned and new builds. we saw TONS in our area and nothing Wow'd us but we came across a top notch high end builder who had a buyer back out about 3 weeks ago and they went ahead and finished the house with 80k worth of upgrades in it. good news for us is the companys fiscal year ends April 30th so they are wanting to move it

they gave us a deal that couldnt be beat so we signed the offer and they are throwing in a fridge and blinds

long story short last night our realtor called me saying that the lady from the builder called her back saying that her boss said that they couldnt go that low and countered with 20k higher than the original offer PLUS no fridge(they threw in blinds)


me, my wife and realtor are pissed. we countered with 5k over our asking with all thrown in and they said no we arent coming off one nickel.


im not sure what to do, the house is great and everything we want and the wife is really pissed because its everything she wanted. for me its the just them not honoring what they said but it was the sales rep, not the actually company. she basically talked out of her arse to get us interested.

what should we do? accept the 20k higher bid with nothing or tell them to F off and we are going somewhere else and call there bluff?

Do you have a contract in writing?

its an offer and we left 10k in earnest money, the lady told us basically it will get done and we talked for 2 days about how she could do it for our price WITH blinds and a fridge

in the end its not up to her but jesus why talk out of your arse like that?

Highland Homes- its a very nice private builder in Texas, very good rep

i wouldn't do business with these creeps. lady had no business making a DEAL she could not see through.

Has earnest $ check been deposited? I'm guessing no.

If you don't have signed agreement, you have very little legal recourse.

I would ask your agent to get her managing broker to call the sellers agent managing broker and discuss exactly what happened, put everybody on record.

Builders company initials aren't H.C. by any chance?

Confused... was the offer signed by the sales agent? If not, I don't think there is much you can do, take it or walk. If it was signed... I'd be raising hell right now.

Lots of friends have bought from Highland Homes. I always thought they were a great builder. Looks like you just got a turd for a sales rep.

if you really want the place go up 15K with everything (fridge and blinds)

If you think you can find something else, walk away

FTR: We would probably walk away on principle. I hate wobblers.

I'd be leaning towards telling them to go frick themselves. They should at least split the difference with you if it was their mistake.

When I was shopping, I walked away from 2 bad deals like that and ultimately ended up in a MUCH better situation.

Worst case scenario, put your stuff in storage and rent an apt month to month until you find what you really want.

I'd talk to the company and explain to them what their rep told you. You might be able to nickel and dime them down a little more. I'd imagine the company, if they are big, can afford to let it sit for a while if it means $20k more in their pocket

If management is okay with these sales tactics I wouldn't want to know what they are cool with during construction.

This is what I'm thinking.

Even if it was just an offer, I would think that they would try to meet him half way. The sales rep might have been a dufus but she's the "face" of the builder. Hard to trust the builder when sales is feeding you BS.

I share the feeling of the people who say tell them to GFY, but pragmatically speaking the OP is about to be homeless and the wife loves the house. I'd probably grit my teeth and poney up the extra money.

It seems to me that whether they signed a binding contract or not is all that matters here. If they didn't sign then you didn't actually have a binding agreement in the first place, so don't get your jimmies rustled too much.

Of course, if they did sign a contract you can tell said boss that he needs to examine the provisions of the clause for breaking it. They might still do it for 20 grand but at least you might get something.
