Interesting tidbits from the Hobby Lobby/Conestoga Wood oral argument

http://time.com/37055/supreme-court-women-dominate-arguments-on-contraception-coverage/

quote:

•Justice Sotomayor and Justice Kagan asked: Because nobody is forcing Hobby Lobby or Conestoga to provide health insurance, they can simply pay the tax penalty instead.

It appears that these Justices are okay with taxing a person for their religious beliefs. I seem to recall someone saying that " The power to tax is the power to destroy."

Sotomayor and Kagan revealed for all of the world to see that they are the most unqualified nominees to the Supreme Court in the last 100 years or more.

Their arguments were completely based on rhetoric and propaganda - there was no constitutional analysis whatsoever that I have seen from either one of them.

Obama has left a swath of destruction in his wake at every turn - these two in the long run may prove to be the most damaging component of his tenure.

There's no "may" about it. These two both view their position on the bench as one from which to further their ideology. shite. They don't even really need to be lawyers to do what it is they want to do.

Is there a more ironic statement than this? And these people are suppose to be some of the best and brightest people in our Judicial system.

"Nobody is forcing you to provide insurance but you are going to pay either way."

The funny thing is, Hobby Lobby is not outright against birth control...they only do not want to provide birth control that kills after conception...like the morning after pill.

Apparently, now, when the govt has a penalty, that isn't considered "forcing" a behavior.

Fascinating twist.

They are making it up as they go along. Fortunately, this administration still enjoys the support of the US media by in large.

They have extending, over and over again, mandates that would affect the democrat party detrimentally (without any legal basis to do so). Yet, no one calls them out on this to any great degree.

True justice would be repealing an unjust law which is Obamacare.

No one is forcing you to follow the law. You can choose not to and go to jail instead.

Does this argument work for the citizens as well as the government?

Can I rob someone and offer the defense that "he didn't have to give me his money. He did it willingly. I gave him the choice of either handing over his wallet or getting shot in the head."

Which is my number one strategic concern.

This is why I can confidently argue that the 'GOP is just as bad as the DEMs' falls flat on its face.

While individual points can be argued - and I suggest that the GOP is slightly better than the DEM in any significant debate - there is no doubt that ANY GOP POTUS would select a better quality of SCOTUS nominee.

And two more DEM appointees to the SCOTUS will permanently destroy the constitution. You might as well allow the constitution to be rewritten every week by another fifth grade inner school class on a field trip to Baskin Robbins.

If a man doesn't like the plan offered by his employer, he just gets coverage somewhere else, such as his own individual plan

Why can't women do the same?

Typical. I mean... even paying the taxes is optional. There's always room in for them in federal prison...

That's within your right. No one is forcing you to pay that. You can instead choose the option of higher fines, tax audits, and possible jail time if you like.

So they're going to make Hobby Lobby pay taxes because of their religious beliefs.

Great compromise for some of the ongoing free speech fights. We could have a govt issued free speech license for a small fee. Of course if the speech were too offensive you could get points on your card that may lead to higher fees or revocation.

It's the one-size fits all approach PLUS the many exemptions that have already been offered by the administration. We all know that our previous policies cover some things and not others. Hell, there are "premium,"preferred," and generic medications all with differing prices.

These businesses should NOT be forced to provide the VERY FEW contraceptives that they are against. There position is very reasonable. I would also like to add that forced responsibility will ultimately fail.

If they do not supply the required benefits they will pay the penalty or the gov't will own their business.
