So back in September this lady backed into me in a parking lot. She gave me her info and left the scene b/c she didn't have time to wait on the cop. I didn't give her any of my info and we agreed she was at fault but now her insurance is trying to get half her damages covered by my insurance. The cop at the scene asked me if I wanted to press charges for a hit and run but I told him I didn't think that was necessary as long as it was clear she was at fault; that was my mistake. I'm thinking now I either want to press charges or at least threaten to, to make this claim go away. Can i do that at this point or is there a better course of action to take?

should have filled out an accident report, man.

Let your insurance handle it.
Police do not assign fault. They only report what happened.
Insurance and courts assign fault.
The woman has no say as to what her insurance will do, either.

That's sorta what I thought. I could contact her and threaten to press charges if she doesn't tell her insurance to drop it.
For the other poster, I did have an accident report. Her insurance company is just screwing me.

Go get a fricking lawyer dont ask the OT these people are retarded. Also, you sound super beta for letting her leave the scene.

letting her leave the scene is the smartest thing he could have done. he should have pressed charges and then her insurance would have told her to "get fricked" with her claim BECAUSE she left.

This. Even if they admit it in writing and on video having an accident report clears out a shite-ton of red tape with insurance companies.

So physically hold her against her will? Do you know what kind of charges that would bring?
OP, be wary of the advice you get here.

Don't go "get a fricking lawyer" over sme BS property damage claim. Let your insurance company handle it. If your premium goes up a bit because you were too dumb to get a report, then tough shite. That's the worst that will happen, though.
