An employee hurt his knee while working. The company paid for his surgery and rehab. The company tried to get him to come back to work. He said that he couldn't. He got a letter from the doctor saying he could only do sedentary work. The company does not have any sedentary work. The employee goes back to the doctor and the company pays for another MRI that shows he is fine. The employee wants to have another scope to see if anything else can be done. Where does it stop???

Is this really something you want to post on an anonymous message board? No attorney is going to give legal advice on here.

Looks like your company will need to make up a bullshite title for the guy and stick him in a office so he doesn't sue.

I would just hope the guy don't read TD. You are talking about how to get rid of an injured employee.

I'm not directly involved. I just baffled by the bull shite that is going on. It is just an opportunity for me to learn something from people that know more than me. I'm sorry I ruined your black panther party.

When his orthopedic surgeon says he is 100% capable of resuming normal activity.

The scope only happens if the doc feels its neccessary (or he may not get paid for doing it), and the insurance and your legal dept will follow the docotrs recommendations.

They are telling the company that we have to offer him a job at the same pay.

Do NOT let him go. They will regret it.

The company does not have any seditary work.

Since seditary isn't a word I'm not surprised that your company has no work of that nature.

Oh, well in that case, learn this; If I were a plaintiff's lawyer and someone referred me to this thread, I would run wild with it. You say you're not involved, but if you are, they will find out.
