Parents kick their 18 year old out & the kid sues parents for support

quote:

New Jersey teenager claiming that her mother and father tossed her out of their home and cut her off financially is suing them for immediate support, current private-school fees and future college tuition. The parents, meanwhile, say that daughter Rachel Canning, 18, moved out voluntarily after refusing to abide by their rules.

quote:

“We love our child and miss her. This is terrible. It’s killing me and my wife,” Rachel's father, Sean Canning, a town administrator and retired police officer, tells the Daily Record. “We have a child we want home. We’re not Draconian and now we’re getting hauled into court. She’s demanding that we pay her bills but she doesn’t want to live at home, and she’s saying, ‘I don’t want to live under your rules.’” The rules, he notes, include reconsidering her relationship with a boyfriend who may be a bad influence, being respectful, and abiding by her curfew. He and his wife, Elizabeth, who live in suburban Lincoln Park, about 25 miles outside of New York City, have kept their daughter’s car because they paid for it, says Canning, and he admits that they did stop paying Rachel's tuition at the private Morris Catholic High School. A hearing is scheduled to take place on Tuesday in the Morris County Superior Court.

I hope the family embarasses the frick out of her in open court.

Sadly, the father's tone leads me to believe they won't.

The parent of the kid she is staying with is an attorney.

Louisiana has an old law on the books regarding support of parents. would love to see a suit on that.

This is probably the part she has a case on IMO.

If it was college she'd be SOL.

Although I agree with what they are doing in principle, I don't think I would quit paying for her private high school tuition(as long as her grades were good).

I told my son that as long as he is financially dependent upon me, there will be rules he must follow.

What a dick

He didn't take the case, but I'm sure it was partly his idea. And I posted what I bet the issue really is, which is her private high school tuition, which I think this parent-attorney is covering.

I think he has a legit gripe on that issue. Namely, because that may come under parental responsibility laws. You can't "abandon" your child's education.

She can carry her spoiled arse to the local public school and finish her high school tenure there

While I think she's acting like a spoiled bitch, it seems like the school itself could possibly come after the parents for the tuition. Most schools make you sign a contract saying you'll pay the year's tuition, even if you pull your kid out early.

I'm definitely curious how the fact it was a "private" school plays into this, since as a parent, you are responsible for sending your child through high school.

And she's also 18 now, so does that end the parental responsibility since she is an adult who can attend public school?

As a parent, I would not drop the financial responsibility as long as she was still in high school. They are not necessarily obligated to pay for private school, but they are obligated to make sure she graduates. Once she graduates they can cut her off.
