The blustering a-hole in him may have wanted to do that.
His lawyer probably warned that it was a really stupid idea, though, given the kinds of things that would be made public during discovery.

He's obviously guilty as all hell but this decision didn't have anything to do with innocence or guilt.
The process by which he was punished was collectively bargained so any lawsuit was pretty much a waste of time.
A-Rod is too dumb and stubborn to see that so I presume that I have to give kudos to his lawyers for passing up more billable hours and giving him some good advice.

Of course he does, the Union was talking about kicking him out of it. Not sure if they could, but they had plenty of votes to do it, before it hits the courts.

Players were pissed, but they could not kick him out of the union. However, several pitchers said he would be playing "dodge the fastball" if he played next year.
