I have an employee that was assaulted in starbucks last night. She was brutally beaten, and suffered a broken arm, and orbital bone. The starbucks employees sat around and watched and laughed. Aside from the employees being worthless pieces of shite, Does she have any legal recourse with starbucks or only her assailants?

Absolutely. Bring a suit against them and they will settle out of court for some amount. They have deep pockets and hate litigation about the safety of their customers.

Have her talk to an atty in San Diego.

I don't know California law

ETA: but in LA, they don't owe a duty to protect their customers from 3rd party battery unless there was a history of attacks

She did file a police report and there is video of the assault.

The attack was unprovoked.

Most stores have policies straight up instructing employees not to physically intervene.

Unless it was an employee doing the beating, probably out of luck unless they throw some nuisance money at you. But it's Cali, who the frick knows.

I don't know if Starbucks employees have any duty to put themselves at risk by intervening in a criminal assault. They probably should have called the police at least, but that may not have made a difference. In any event, Starbucks would probably fork over some cash just to avoid the bad publicity.

Extortion. The American Legal System way.

The video will help. If the beating was egregious enough Starbucks will try to settle as quick as possible before the video gets out to local news, especially if their employees literally just stood around and laughed like you said.

Maybe it was knock out game to start, but the beating went on for over a minute.
