Libertarians: how much power should employers have in firing workers?

Should private companies be allowed to fire workers over race or gender? Should there be laws that allow workers to be notified reasonably well before the decision is made?

Why would a company that is going to fire someone over race or gender hire that person in the first place?

No, there should not be a law dictating a company notify an employee they are going to be terminated. Such an employee could wreak havoc on a company. You can make an argument for required severance pay.

Why do you have to be a libertarian to believe that private individuals should be free to associate with whomever they choose? You don't have to be a libertarian to believe there is no constitutional support for aspects of the CRA.

Thats crazy. Racial and sexual discrimination is illegal and wrong. Companies have the right to terminate em0ployment at any time for cause. Fired for being black or woman is not cause.

No doubt that firing a woman or racial minority solely on those grounds is wrong, but is being forced to hire them on those grounds a'okay?

That question doesn't make a great deal of sense. If I'm inclined to fire someone solely over their race or gender its highly unlikely I would have hired them in the first place.

Calm down. He's asking Libertarians, not insinuating at any point that you have to be one to believe his original question.

Exactly.

If I am hiring for my own private company I will who and what I want. No government is going stop me hiring or forcing me to hire someone.

If you want to say he's not directly associating the two, fine. But if you think he's not insinuating it, you are incorrect.

As others have stated, a company should be able to hire and fire whomever it wants.

While it is a complicated issue, its not our business to directly to regulate hiring practices.

I am trying to think of a scenario that would allow your question to be an actual event.

So, lets assume some guy, who has a mixed labor force, sells his company to someone else. The new guy takes over and fires all women or people of a race that differs from his. That scenario presents a problem. However, I dont think the government should have to step in. Those employees could either campaign to the public to boycott or start their own company and compete against their ex-employeer...or just go find other work.

In a libertarian world would there be bankruptcy protection? I have always been of the opinion that an individual should be able to do anything they dam well please IF they were willing to forego their right to file for bankruptcy protection.

I also think this applies to using the state as muscle to collect debt. If you are willing to forego the right to ask the state to assist you in collecting bad debt then you should be allowed to conduct business in any manner you see fit. If you want to fire someone because they have changed their hair color more power to you, but when your piss poor business decisions bite you in the arse don't come crawling to the state begging for protection from your creditors and if you have a bad debt be responsible for collecting it one your own. If you going to be a self reliant rugged individual then be a self reliant rugged individual.....and good luck with bonding.....

And contrary to popular opinion no government will attempt to do so. There is no such thing as a hiring quota....it is simply a myth akin to a unicorn.....

Nobody successful in business is going to fire anyone based on race or gender. I am sure it happens but those companies don't last long.

If I own a business I should be able to do whatever the hell I want as long as I am not violating any agreed upon and signed contracts/oaths.
