Soooo... I win a straight auction on an item but the seller doesn't ship and no response from him/ her for an update. Going on 10 days now since winning the item.

Apparently at this point the seller has to agree to cancel but how long do I have to wait for my funds to be returned if the seller never responds?

Do a paypal chargeback and you'll hear from the seller immediately.

Have you opened a dispute with Ebay?

I'll investigate the paypal charge back but according to ebay his paypal is still pending and has not officially received the funds.

The ebay rep never did mention that was an option but I guess its in their interest for the transaction to complete.

I should have added this was the seller's first sale.

I believe I did... part of it was requesting the seller to cancel the transaction.

Yeah, paypal changed it to where you don't immediately receive the funds. Its usually pushed out 10 days or until their is a delivery confirmation. But if its shows "Paid" on the screen then he should have shipped it.

If the item was more than $50, dumb on your part to buy.

LINK /

Open a case number... The communication between you and the seller goes through them. Even though Ebay can already look at your inbox, it makes it easier this way.

Thanks for the link... that's what I attempted yesterday with the help of an ebay rep.

But apparently I can't open a dispute with ebay because ebay officially thinks the seller didn't receive the funds due to his paypal acct. still pending.

I'll try the paypal dispute and see how that goes as someone has suggested.

The item was less than a hundred but I figured between ebay/ paypal and using a cc I had a couple of remedies if the transaction went bad.

Like I said, they are always pending these days... They hold the funds until theres confirmation of delivery.

I'd go through Paypal then. Open a file with them.

Ha...

From Paypal:
quote:

This transaction cannot be disputed at this time. This is usually because the transaction has not yet been completed. If this is a completed transaction, please double check that the Transaction ID you selected refers to a payment that you sent.

Going to try and talk to a paypal rep... It would have been great to get a warning from ebay or paypal that his acct was pending before they took the transaction. Oh well lesson learned.

ETA: I clicked the details and it says payment is "not claimed"... Paypal allows you to cancel unclaimed payment but not dispute.

Sellers don't always get the money right away. Experienced ebay sellers ship right away knowing they will get the money from paypal eventually. I went through this when I bought from a vendor on craigslist. I had him invoice me on paypal and he wasn't really active on it so it took like 1.5-2 weeks for him to get the money. Dude wouldn't ship my stuff until he got his money. He did respond to my emails though.

So wait, they were 'Verifying" his account registration, yet let him list something and sell it?

Apparently so... I even asked the ebay rep why would they allow someone to auction an item without an active paypal?

All he could say was there are other methods of payment... Which I replied well with paypal the predominant payment method of ebay it sure would be nice if you all verified a paypal acct before you allowed an auction with a paypal payment option.

Ebay owns paypal. They don't care if you money is tied up over there.

Look in the auction does it say "Item qualifies for Ebay Buyer Protection"?

Once you wait a certain amount of days and you can prove you've asked the seller for a refund, open a case with Ebay and you'll eventually be reimbursed.

Ebay/paypal will get your money back, it just takes a certain amount of time for the process to work itself out.

Don't go over 45 days. You are screwed then.
