I remember reading this story back in July or early August. Twas just a rumor at the time though. I was surprised it didn't get that much airplay then. I wonder if it will now.

Yea, this is actually old news but I guess it wasn't official. The story was out there though.

I think what is "new" about this story is the DR told the police he was a threat to society prior to the incident.

As I said...I remember hearing and reading about this last summer. The psychiatrist broke doctor-patient privilege, something that doesn't happen unless the doctor perceives an imminent threat, to warn the police that her patient might be a homicidal madman. This was reported back in July or August.

Colorado has a 20-day, court-ordered commitment I think. The only fuzzy area of their commitment process is that they look primarily at NEED for treatment and not only at danger to self/others.

I am wondering what this psychiatrist mentioned in her full statement? She notified the police but if her statement recommended forced committment then this is worse than I thought.

If a known problem to society is able to carry out a mass murder even after the authorities we were notified and there are existing laws in place to prevent it. How in the hell is the federal government going to be able to implement more detailed background checks to prevent this from happening again.

IF the current laws were enforced none of this would have happened.

I was only considering if the psychiatrist had stated clearly that the shooter needed to be hospitalized or if she simply warned the police "in general."

I agree with you that there is no excuse for the lack of follow up by the police on this report. The Feds can't do shite efficiently or even follow the laws that are on the books. Hell, we all know that most gun laws and immigration laws are not enforced. It's all about accountability.

Late to this.

You have to have judge sign off on an involuntary commitment order. Just like any seizure of a person or property, you need a warrant. These orders are very hard to get even for family members.

Exactly. This is a huge issue in today's society.

If you get the time, you should read this book to see how fricked up our nations laws are and how mentally ill are treated in this country.

Not in louisiana. A person can be pec'd and the cec'd pending a commitment hearing. The restrictions are pretty rigid, but between the 2 non judicial commitments and the stautory time you have to have a hearing you have plenty of time to commit pending hearing. Don't know colorado's rules.
