Hiring a lawyer to minimize the damage, financially and otherwise, isn't "fighting" it. You should have hired legal counsel, regardless.

You don't have to hire an attorney to see court records that are public record.

Your BAC in a blood test might be below .08, but they use a mathematical formula to figure out what it was when you were arrested.

Doesn't being intoxicated require using an intoxicant? Doesn't being under the influence require something to be under the influence of?

don't know the legal jargon, but impaired is in there somewhere, and fatigue counts, had a friend in LA get a DUI/DWI on his way to work one morning, after working a night shift at a second job, eventually got it reduced, but it cost a lot of $, and was a hassle

Yeah, I've beat a few things based on technical legal mumbo jumbo before. I am not gonna try to find Tennessee state laws on my phone, but I'd like to see how they have it worded

Hell, I got out of a drunk in public because walking around a gas station signing isn't technically public. I was definitely shit-hammered, just not in public

im still pleading on one i had last year..

.10 in a parking lot, hit a parked car trying to get in a tight parking spot


The laws in MS are tough, especially since i am over 21. I am hoping I can get out of it somehow..This will be a huge black mark on my resume and future job opportunities

As others have said, you should have hired an attorney specializing in DUI cases. But it seems you know that already.

This is a good example why you needed an attorney. If the blood tests truly did not say what was presented in court it doesn't matter what the camera shows. If they present evidence you can show is false, you immediately move to have the charges dismissed.

If they didn't present certified test results move for immediate dismissal, not a continuance to let them get their shite together. Get the lab tech on the stand if you can.

The camera footage doesn't mean jack, your goal is not to show you were "really okay", your goal is to show the prosecution doesn't have evidence to convict.

Don't know if the obvious has been posted but have you gone to the PD and filed a request for the arrest records? Clerk of Court for the court and evidentiary records?

As an Army recruiter, i've had the unfortunate privilege of having to get these records for applicants who have had a DUI in the past. With most all of the cases, I can get records that have the actual breathalyzer or BAC results.

Well I'm 33 and not really Al worried about a resume but who knows what will happen later in life. It's there forever. It sucks.
