So I just found out the DOMA hearing is a result of $300k in taxes???


Ill admist i havent followed this closely but I thought it was about the people not the money?

Yea, I listened to the background of the case on NPR the other day. Sounds like this couple (lesbian) lived together for 40 years and married once NY legalized gay marriage. The spouse was left a lot of money but she is being taxes 340k that normally a traditional married couple wouldn't have to pay. I mean, it seems unfair but the problem is there is no federal protections even though gay marriage is allowed in NY.

I think wanting tax breaks and other federal benefits are what this is all about. I don't think gays are that upset that they can't call each other husbands or wives. I also think it is an effort by the left to errod away our values, but our society is doing a good job of that by itself.

You need an issue that the courts will address to challenge a law. And monetary issues are pretty obvious ones to challenge. The principles of equality are nut undermined just because the litigated issue is primarily monetary instead of primarily social.

But a piece of paper written by degenerate politicians will never allow or disallow any two people from any group to love one another. Therefore it's about benefits and taxes.

this is also about establishing "gay" as a protected class since you can't argue gender discrimination and sexual orientation is not recognized as a "class" in the law.

Why do we even have any protected classes anymore? We elected a black president. We have a littany of industry executives that are not old straight, white males. Everybody has biases.

What's next? Overweight people as a protected class? Should make the healthcare debate interesting.....

On what grounds can you legitametly deny a gay couple the same benefits and protections under that law that heterosexual couples fully expect? Without any hyperbole, which any political issue is steeped in, what is the basis for not affording a gay woman the same benefits, say social security survivor benefits, when her partner dies? There is no legitimate way to do it.

Here is the deal. It is a matter of syntax and for whatever reason we allowed the state to infring on the churches territory. States should have never been in the marriage business. What states do have business regulating is partnerships, and that is all a marriage, outside of the church, is. It is a business deal, and the state has no business telling individuals who they can enter into a partnership with. The church, on the other hand, can do anything they dam well please. What should'nt happen...and does not in any state I am aware of, is a church sanctioned marriage accepted as a legal partnership....it takes a license issued by the state to be legal in the eyes of the state. Again, marriage is an institution of the church, partnerships are an institution of the state, and they should be separated. No heterosexual couple who is married in the church but who does not have a marriage license from the state should have any marrital benefits, period. The state is the only entity that should matter when it comes to any legal benefits and the church should be allowed to counduct marriages between who they please. No heterosexual couples marriage should be recognized by any state, only the partnership that is sanctioned by the state. Unfortunately the state, in romantic bliss at one time, decided to call a domestic partnership a marriage, and here we are.

I think it goes to the whole question of equality and the legitimacy of our current tax system. Of course the rights should be equal.

But don't kid yourself and say that this whole argument is about government regulating romance or trying to deny someone's happiness.

It's about taxation, and the ways in which our government tries to encourage behavior through tax benefits and punishments. So why not treat everyone equally is my question?

Why not move to a tax system that doesn't take into account anything except the fact that you made money in a given year? Why do we punish renters? Why do we punish single people with no children? Why should a single mother with 6 kids be given a break on her taxes when she uses more of the services anyways?

I thought liberals liked paying more in taxes. Funny how they consider tax reductions a "benefit" of marriage, but a loophole when speaking of the rich.

What's interesting is if these two had been sisters they would have had to pay the tax. I think the court will have to be very careful it's decision doesn't get extended to sibling marriage.

I agree. But it shouldn't apply to just sexual preference. Why do the rich have less right to their own money than the poor, for example?

It simply highlights why I'm a proponent if a flat fee tax. Federal budget / population = your tax.

Nothing could be more fair or equitable.
