The standard to deny someone UC benefits is: did the employee commit "willful misconduct"

Why would the employer challenge an unemployment claim?

looks like it went up since i had to be on it, 3 years ago shite sucks. Former employeers will try and screw you over b/c they have to pay a %. Mine claimed they fired me for employee misconduct. When i was laid off, so i had to have hearing with the unemployment office and the HR office. The HR person was basically like i have no idea why his file says this. So i got back payed like 3 months worth b/c it took that long to even get a hearing. Good thing i saved money or i would have been dead broke for those few months.

Updated : Unemployment has a maximum of $235 (see list), that seems low In my job I deal with low income people on Medicare and Medicaid. Today I had a really sad case where a woman had been harassed by her boss and was still working at the age of 70 to make ends meet. Her nerves were shot and she had to quit. I helped her apply for unemployment online. At the end of her application process the website told her she qualified for $60 a week with a maximum of $1560 total benefit. She said she worked her whole life and was only worth 60 bucks a week? I got to checking on the chart and it says the maximum is $235 per week. I always thought if things ever got too bad I would file unemployment. I could make more money standing out in front of a Walmart with a sign! My heart goes out to anyone on unemployment. Maximum Weekly Unemployment Benefits for 2013 Alabama - $265 Alaska - $441 Arizona - $240 Arkansas - $457 California - $450 Colorado - $454 Connecticut - $555 Delaware - $330 District of Columbia - $405 Florida - $275 Georgia - $330 Hawaii - $560 Idaho - $343 Illinois - $385 Indiana - $390 Iowa - $459 Kansas - $420 Kentucky - $415 Louisiana - $258 Maine - $372 Maryland - $410 Massachusetts - $653 Michigan - $362 Minnesota - $585 Mississippi - $235 Missouri - $320 Montana - $446 Nebraska - $348 Nevada - $398 New Hampshire - $427 New Jersey - $600 New Mexico - $455 New York - $405 North Carolina - $535, $350, effective 7/1/13 North Dakota - $470 Ohio - $524 Oklahoma - $368 Oregon - $507 Pennsylvania - $573 Puerto Rico - $133 Rhode Island - $566 South Carolina - $326 South Dakota - $295 Tennessee - $275 Texas - $426 Utah - $451 Vermont - $425 Virginia - $378 Virgin Islands - $454 Washington - $604 West Virginia - $424 Wisconsin - $363 Wyoming - $387

It's official, you don't know unemployment works.

For starters, that list is off because the max in La is $247 now. It goes up and down based on how the La Truat Fund is being utilized. More people filing=less benefits and vice versa.

But beyond that, unemployment is not a lifetime achievement award. You have to calculate a benefit amount based on the last year's worth of income the person has earned.

Also, payroll taxes pay for this person to collect. Which means she's never paid a dime into the system personally in order to benefit from it. That's right. Her employer(s) foot her bill.

Which is why it's ludicrous to imagine jobs she had 30 years ago being held liable for her collecting benefits now. You can't go that far back and hold tax rates liable to increase decades or even years later.

Don't bemoan a system. Learn how it works.

he didnt pay a dime in to get that money. His employer pays payroll taxes quarterly and is liable with their tax rate based on how many employees draw out of the trust fund for those benefits.

Way to show off your knowledge, bro.

Employees only pay half of unemployment insurance. Employers pay the other half.

Because your payroll tax is somewhat dependent on how many former employees file an unemployment claim.

You idiots who say this must not have lived in the real world for very long? Life does not always go as planned. Someone who has worked their whole life whether it be as a cashier , garbage man etc... should not be labeled as this. Now all the losers milking the government sitting on their butts pumping out more kids have at them

What did she do with her money her entire life to have to have to rely on gov't handouts at 70?

How about go work for wal-mart first, you leach. Unemployment is supposed to help you when you are in dire straits. It is not meant to be a place to go when you refuse to work anywhere else.

How is working at wal-mart beneath you, but going on welfare is not?

She was a cashier at a truck stop for her career, who was taking care of her grand-daughter because her daughter died of Lou Gehrig's disease (ALS) and her son-in-law took all her daughter's life insurance and went and blew it on drugs.

So she was a shitty parent too? What are the odds?

Odd thing is from my work experience, those who try and work get penalized. Medicaid will drop you like a hot brick if you get a job. Food stamps same thing. If you just go ward of the State you get more. So the Gov does not typically reward incentive. It is like when you really need 500 but someone spots you a 20.

This is the most a-hole-ish statement i've ever heard. So instead of saying, "thanks for the 20, it will help" you demand $480 more? No wonder you work in government.

Some people are just mean. I was on unemployment when I moved to Hawaii. You can only beach so much and quickly got board not working. Offered and gave free maintenance to a bar/restaurant I frequent(I was getting paid after all right?) They loved my work so the owners offered me a part time job which meant I would basically be working for free since I was on unemployment and every dollar made is deducted. When I decided to quit and move on, despite giving them tons of free maintenance and the benefits I was drawing from were from out of state which had no affect on them, they caused hell through my UI.

From laworks: Who pays for UI?
In Louisiana, employers pay all of the costs of UI through a payroll tax or reimbursable program. Employees do not pay any part of their wages to finance the UI program.
