According to the story from Drudge ( LINK ), it seems Kennedy's hang up is that DOMA seems to take the ability to define marriage from the states.

If that's his position, then it may well be that DOMA (at least the section that is being challenged) will fail, but Prop 8 will be upheld.

The case will be thrown out because the plantiffs (Prop 8 supporters) had no standing for bringing the case to the SCOTUS. Basically what I gather is that the lower court (District 8) decision will stand because Proposition 8 was found to be Unconstitutional. In other words, gay marriage will be legal in California and the legal battles will continue in the courts.

So, it's not a sweeping win for gay marriage but a significant victory none the less.

Liberals love federalism when it suits them, a la DOMA.


Liberals hate federalism when it doesn't suit them, a la abortion.

The court is so f'n inconsistent.

Doubt it. The one thing the court is not, consistent.
