Why in the hell can't we have some sort of lawsuit reform?


Instance such as this drive up costs for the rest of us, and to award a judgment in their favor is a moral hazard, only begetting more absurd lawsuits. The person who filed this lawsuit should take his $8,000 and shove it where the sun doesn't shine. This is nothing more than legalized theft.

I'm not sure of the solution, but we need to get this shite under control and fast, because it's completely absurd and killing our country. I understand money talks, but there has to be a way we can reasonably seperate that from the legislative process.

The Trial Lawyers are the 2nd largest CASH contributor to the Democrats, the Unions, SEIU/Trumpka are the largest. Trial Lawyers started doing the Workman's Comp frivilous lawsuits for the unions and grew to all the
un-neccessary lawsuits filed today,a major cost to job creating businesses, Liability Insurance is EXPENSIVE and too high due to lawsuits. 90% of the lawsuits we fought for 34 years were phony and backed by lies. Just like the Reid,Pelosi, and Obama lies they do. That's where they got it from and see it as normal to do. The Democrats and Obama will fight any reform ,even if it's good for jobs and the economy. Texas did reform it and look at the good it did for their economy.

Regardless the man should have been to F off and take his absurd shite elsewhere. I'm really sick of hearing all of these folks who are offended, upset just because they are not being individually catered to.

I know the story is absurd, but what would you propose to stop this type of activity? Most tort reform deals with top-end litigation (meaning the really big cases, using damage caps). This little bull shite would require an adjustment of the pleading stage. Not bashing you, but I would like to hear what you would suggest as an antidote.

First off, that doesn't sound like fun.

Especially that song...the fun Nazis need to be held accountable.

You sound like those Tort reform brown shirts who latched onto the McDonald's hot coffee case w/o knowing jack about it. Tort reform is a scam and ruse by bought politicians and insurance companies to screw the public out of restitution and forever to make corporations immune to "behavior changing lawsuits" - punitive damages. No punis, your life is worth dick to me as a corporation. Recall is more expensive, changing the operations more costly, new design will cost too much.

It always makes me laugh when I see all these "reformers" - god, the courtroom is the last stand for the average joe against corporate America. It's the one way we can fight them in a fair fight. They already have State Congress and Washington.

well if disney paid him voluntarily, then i mean...that's their choice

if a jury awarded it? that error is on the jury

i don't know how you plan on preventing these from occurring

Suit was filed in U.S. District Court in Santa Ana. Geffen said the court awarded $4,000 for negligence and $4,000 related to other access violations.

I understand it may not have been comfortable, but why in the hell is he entitled to $8,000? Piss over the side if he has to go that bad.

I've had panic attacks before, give me a fricking break....you can't account for every situation for every single person.

There was an earlier thread bout changing the tort laws to where the loser pays, with a cap, in any civil suit. But as for the court room being the last place the poor have to take on corporate America, at least make it a fair fight. Walk into any courtroom in CDC ( Orleans Parish) and see just how fair it is. And it starts with the O.P. judiciary & finishes with the O.P. jury pool. And do you honestly believe the Morris Barts of the world, and there are 1000's of them in the court system, believes they are fighting for justice? Bart got filthy rich by taking volumes of cases, not quality.

Every poster on this board harps day in and day out about their rights being taken away - do you really want to give up a truly basic right to have your day in court. I cherish my freedom to have my day in court over my choice to own a surface to air missile without having my background checked. Judges are there to throw out frivolous cases and they do it all the time.
