Should gay marriage be decided by the states or federal gov't?

I know, I know. Another gay marriage thread but I don't think I have seen this discussed today. If otherwise, I apologize.

Should gay marriage be left up to the states to decide or should it be done on the federal level?

For the record, this is just a nuts and bolts discussion and it should in no way discuss whether gay marriage be legal or not. Just who should decide the legality of it.

I think I want the states to decide it.

Dunno. I feel like two consenting adults entering a contract should be legal everywhere. I have literally hurt my brain trying to see this from the other side.

So I guess it might be a federal question

Either, it doesn't matter. It should apply for anyone over the age of 15 (16 and up) and should be a civil union.

Marriages should be conducted by churches.

I use this terminology so retarded conservatives can't spend 4 hours bitching about semantics (noooooo marij is relijus!!!)

It shouldn't be decided by the states or the federal government. It should be decided by the two individuals contracting with each other.

But is 2 consenting adults being denied the right to enter a contract a federal question?

you cant deny two individuals to do that. if government isnt involved with any marriage, at all, suddenly this whole issue evaporates.

There is no way for this to be tenable.

Marriage is something that comes with myriad other related actions. Moreover, for states to decide, should you choose to get married in a state where legal, you would basically be eliminated from carrying that marriage anywhere but another legalized state.

Finally, on the Federal level, you'd have the net effect of some people being "married" for things like taxes while others could not be.

Now, I'm against govt marriage licenses at all, but if they're going to exist in their current form, then there is simply no reasonable way for it to be handled only at the state level.

The same way other marriages are decided?

So you're saying it should be decided by the feds.

I was saying states because I absolutely despise the feds and am very pro states rights and I think social issues should be decided by the people of that state and what they really want.

I despise the feds but my point is simple. Right now, marriage comes with a GREAT MANY strings tied to the Federal government. YOu can't have a situation where people in one state qualify for marriage but would not in another state. They wouldn't be able to relocate and carry their marriage with them AND, in certain states, they'd qualify for Federal programs while in others, they would not.

Now, I hate the fact that marriage comes tied with that shit, but if it is going to continue to do that, you can't deny one group of adults what you grand another group of similar adults.

is a marriage license issued by the state or the federal government. the issuer should make the decision.

When you get married in Louisiana but then move to Florida, do you need to get a Florida license? Why don't you?

THAT is the problem.

That's fine until you run up against that pesky full-faith-and-credit clause in the constitution.
