Should homosexuality be a protected class?


I can see this being abused.

Title VII of the Civil Rights act prohibits discrimination on the basis of race, color, religion, gender or national origin.

Do you agree that sexual orientation should be included as a protected class under Title VII of the Civil Rights Act?

If we are going to have protected classes, it seems like they fit thr mold. That's separate from whether marriage as the founders viewed it should be changed.

I support same sex marriage but not this.

If this were to happen, what to stop me from yelling I'm gay and I was discriminated for an easy cash grab? How can you prove that you're gay?

I don't think anything good can come out of this.

Every business owner would be a gay business owner. The population of gays would grow from 4% to 90%.

It's not much different than "proving" you are of a certain religion.

These cases don't really come down to whether you are a member of a protected class (EVERY person is a member of a protected class after all) but, rather, whether you can prove that were subjected to actionable discrimination BECAUSE of your protected class.

The above are members of AT LEAST two protected classes, probably more. White (color) and male (gender).

I think if sex is protected with intermediate scrutiny, gays should be as well. However, if it were up to me, all of the protected classes would be under intermediate or rationally related scrutiny. Do away with strict scrutiny.

As an ideal libertarian, I would say yes.P

ETA: just like I would support hiring and firing Christians, hiring and firing atheists, hiring and firing stoners.
