It's not a "hole". It has mass. Things that get sucked into it just become part of the mass. The fact that it looks like a black "hole" is because of it's density and velocity, nothing can escape, not even light.

Hawking radiation, like everything else associated with black holes, is only theorized. Even so, the theory does not contend that the radiation is emitted from the black hole itself, but rather caused by the immense gravity of the black hole, originating and projecting from beyond the outer rim of the event horizon, and thus not past the point of no return.

Of course it isn't merely guesswork, but you mistakenly include the word "facts" in your argument, because theories (in context) are based on the laws of logic, and are merely educated and diligently thought-out attempts to explain nature and the universe, based upon observations. When a theory is supported by enough undisputable facts, it ceases to be a theory. Even the strongest theories, by their nature, are either unconfirmed, or as in this case, as of yet unconfirmable, in spite of overwhelming evidence in support.
