ok my last help request with my new job



accepted the offer and everything is good.

i start on the 18th but i still have my current job and havent told anyone.

heres what im thinking and let me know what you think. please note that this is a direct competitor of ours

i really want to milk as much $$ as i can out of my current employer so im thinking i will work all of this week AND next week and tell my boss the truth next friday knowing that their will be no way they will want me to stay and cut me loose next friday. i will give a written two weeks notice as well as a verbal but best case scenerio is they cut me loose and pay me two weeks. worse case scenerio is they honor my two weeks and i start my new job the following monday and have to tell them i need to quit asap. (i highly doubt this will happen because im going to a direct competitor and ive known 4 people do the same over my years and all of them were asked to leave that day)


that way i wont be out any days pay and will be happy. i can earn this weeks pay and next weeks and start on new salary at new job the following Monday. What say you

yeah but you dont understand why would i give notice now knowing they will cut me now and have two weeks with no pay? im calling their bluff and betting they cut me next friday so im looking like the good guy and giving two weeks in writing next friday and they will tell me to just leave then. so its a win win

I'm an employer so I'm looking at this from a little different perspective.

Now, consider the fact that in his other thread the OP has already admitted to talking to someone at his new company about his salary. That is a huge no no in business. If somehow that information got out to his new superiors he may not have a new job to begin.

I'm guessing he is simply very inexperienced in working in a professional environment.

An employer can't do this.

An employer can't do this.



Why not? Employers are not required to pay for non-work, unless there is a contractual agreement which requires them to do so.

Because if you give a two weeks notice, and they tell you to leave and not come back and they are not going to pay you out for the 2 weeks, they would be firing you. You could collect unemployment if they did.

There's a waiting period for unemployment insurance. In Louisiana it's one week. Additionally, if you have already accepted a job I don't think you can file for unemployment just to collect it for a week.

That is correct, which is much different from your statement, "An employer can't do this."

An employer CAN refuse the two weeks notice and terminate the employee immediately. It happens all the time.

I would find it hard to believe that whether or not you would have accepted a new job has any bearing on whether or not you can collect an unemployment check. It is still wrongful termination to just fire someone because they put in a 2 weeks notice.

I worked for a major accounting firm in Houston and left at the end of August 2012. I put my two weeks notice in and then some stuff ending up happening so they told me to just turn my stuff in and leave. I was paid out the rest of the two weeks and was paid out my PTO balance. Think it had something to do with the fact that the two weeks notice was already in writing and that they can't just fire you at that point. I have never heard of any employer telling someone to turn their stuff in and then NOT paying them anymore just because they turned in 2 weeks notice.

Ok thanks for the correction on the verbiage I used. This is not something that happens "all the time". If that happens all the time then you must work for some real a-holes.

Not really working for a-holes. It just depends on the position. If it's a sales position you can bet on it that they'll accept the resignation effective immediately. It's not firing the employee. It is simply accelerating the terms of the two week notice.

Different industries I guess. Being in public accounting, that is something that would not happen. Maybe they are just too concerned with their image and the potential backlash if they were to do it.

Regardless, I would still put in a two weeks notice. Not turning a two weeks notice in based on the assumption that they might tell you to not come back and that they might not pay you for those two weeks is pretty shitty in my opinion. Very immature and childish and not something that should be done in a professional world.

How so?

If the company is a group that is directly competing against others for business, they are going to let you go because
1) They know you aren't going to be committed for the last two weeks
2) You could take company info with you
3) You could do something shady

Hell, especially in the O&G industry, if you work anywhere near the business development/trade floor, you are immediately escorted out of the building with security. You aren't allowed to go back to your desk.
