Before Steve McNair entered the NFL, a couple of San Diego DJs trademarked the phrase "Air McNair"

He managed to get control of the name back, though I don't how it was resolved specifically

How many stupid analogies are you guys going to come up with?

RE is a physical asset buying it, even to capitalize on something else, like say Exxon building a new office park near by, is not remotely the same as taking someone else's name and copyrighting some clever play on it.

ETA: When you buy RE, you do have to pay the previous owner, same thing when you buy stock. You can't just file a form with the giv't that says you own stock.

I suspect you guys are just lashing out because you don't like Godell or the NFL as an entity.

It was already his nickname in college. They tried to claim jump.

He did get it back, but I don't know the details

FWIW Pat Riley TMed the term "threepeat" and gets a royalty whenever it's used.

So some SB tickets and accommodations and an autograph of goodell (that's weird) probably could've squashed this and the nfl would be made to look like it cares about the fans.

If you're the first person to think of trademarking something, and you go through the effort and spend the time/money to do so you deserve whatever comes of it.

Especially considering how much of a crapshoot it would be that some word becomes famous.

I hate to say it but the NFL is in the right here. We have already been through this with the cyber-squatting laws. With the internet explosion people started trade marking things that they knew would someday have value to someone else. Their only intent was to sell it to the companies when they came calling. This is very similar to those rulings.

It really just comes down to a slippery slope that can get too complicated to properly regulate.

I will say though that I am surprised the NFL wouldn't award him his copy right costs. He probably could have at least won that by lawyering up.

I agree with the real estate example. You buy land because you know that eventually it will increase in value. Holding onto that land without developing it doesn't make you a squatter.

If the Harbaughs had never made it to "The Big Game" (don't sue me NFL)then this guy would look ridiculous. Same as the guy who buys a plot of land and then finds out that the interstate ISN'T coming through his property.

I'm sorry I didn't explain myself well enough. This an IP question. There is always only going to be so much Real Property, but IP is almost limitless. that is the reason that they operate under different rules and why IP laws are vastly different than laws dealing with Real Property. This is why is was trying to point out why this is like the cyber-squatting craze and not like buying real estate. That is the point I was trying to make.
