I'm a student at LSU with a Tennessee drivers license. I went to Bass Pro today to buy a benelli but the guy behind the counter (college-aged) claimed that federal law prohibits the sale of ANY firearm to out of staters unless they are a neighboring state. I was skeptical, so when I got home I called around and talked to a guy at Precision Firearms who said with "100% certainty" that the guy at BP was wrong. He said this federal law applies only to handguns, and that long guns were fine as long as its legal to own in both states involved (which obviously it is in Tennessee).
I call back the BP guy to ask him to double check and he again insisted it was illegal despite what I was told.

So, does anybody know the proper legislation involved with this transaction? FWIW most of what I've read online supports what the older man at PF said however there was also some stuff that sided with the BP guy.

Let McGyver buy it then just have him "lend" it to you.

It's only handguns, I've bought a rifle at the bass pro in Orlando before.

I don't think you register anything. They just run your name and you fill out a form for Purchase.

Yeah the BP guy is wrong. You can still buy long guns as long as your state doesn't have any restrictions, which it doesn't.

Registered was the wrong word I guess...but let's say the gun was recovered at a crime scene, could they not trace it back to whoever originally bought it using the serial number?

This is what I figured.

They could within 7 years, after that the forms are destroyed

I don't think there is any way in hell that they are not saving this information when they get a background check. They are legally not supposed to but I bet they file that information away somewhere. It is just too easy to secretly save in a computer somewhere (just in case).

Everyone here who said BP kid was wrong is correct. As long as the buyer passes the criminal background check and there's no other reason to preclude the purchase, he can purchase rifles or shotguns across state lines; OTOH, handguns can NOT be purchased across state lines.

ETA: Why bother trying to teach BPS the correct rules? If BPS insists on not legally selling you the shotgun, take your business to someone who DOES want your business. Unless on sale, BPS prices on guns are not usually very good.

Well initially I had never heard of the rule (probably bc it's nonexistent) so I just accepted it assuming the guy who works behind a gun counter knew what he was talking about. I never went back, but I did call the same guy an hour later to let him know (politely) that he was wrong...but he insisted. I'm just getting a Nova and it was 399.99, nothin fancy. I'm just gonna go to cabelas today after work, sorry BP, train your folks better.

ETA: ill probably go check out Jim's firearms on Siegen first since its across the street from where I work, I just don't know anything about their gun selection/prices.

Possibly going to get a rifle today, and just noticed that my drivers license expired. Do i need to get it renewed first? Never bought a gun "officially"

Yes you have to have a valid ID. An expired DL is not valid.

I bought my .308 in the Bass Pro Shops in Nashville. I live in Alabama.

My mom and dad bought my 870 in Kmart in Mississippi...we lived in La at the time.

Law only applies to handguns...as it's been stated already.
