Also, I'll add the flip side, if the Court rules that a law is unconstitutional. then the argument is likewise over. Agree or disagree?


you know cases being challenged on the same constitutional grounds can make their way back to SCOTUS correct? Therefore, I don't think people should quit challenging them simply because THOSE 9 justices ruled it constitutional. Another court could come out with a different decision.

The dictators in black robes have declared themselves the sole administrators of the Constitution but they have no Army or Navy to enforce their decrees so they are cautious not to conflict with the consensus of the whole of the people.

Therefore, don't discount the influence of politics on their decisions. The culture and ideas of the masses have influence, but it takes a long time to change the thinking of a large culture. Over a long period of time, and with enough advocacy, the general culture can come to accept things like: abolition of slavery, women's suffrage, racial and sexual integration, abortion, gay rights, drug legalization, socialized medicine, or any number of ideas that were unthinkable in the past.

The arguing does not stop because there is always the chance to change the culture over time. If you do that, the court will bend itself to that change, at least to a degree, and sometimes it will do a 180.

This is why ideas are so powerful and as the saying goes; the pen is mightier than the sword. This is also why the guardians of freedom must never cease its defense.

I don't think this was firmly established in the U.S. until Marbury v. Madison (1803); "judicial review" as we know it isn't explicit in the Constitution.

Off the top of my head, Lincoln ignored the Supreme Court early in his term over suspension of habeas corpus ( LINK); many thought Richard Nixon should have or would have ignored the Supreme Court (or at least destroyed the evidence) when the court ordered him to turn over his Oval Office tapes in 1974, but he complied (minus the 18-minute gap) with U.S. v. Nixon.
