So heres the scenario:

My dad and I own a small plot of land (80 acres) in north/central la that we deer hunt on. It borders fields on two sides and in one of those fields approx 1000 yards away is an 11 acre brake that sits in the middle of it. The people who own the 11 acres never hunt it and havnt hunted it in close to 5 years now. They are from far off somewhere, where exactly I'm not sure. We've been in contact with the real estate agent over said land several times about buying it, but it hasn't yet come up for sale.

Long story short I would like to go hunt it so bad, but in the 8 years we've had this place I've never once been on it. I keep telling myself that I'm just gonna go hunt it one morning late in the season if nobody ever comes and hunts it but I know that's not the honest thing to do.

What would you do if you were in my situation?

I would be a little skeptical, since anything like that could turn into a bad situation. But if they live far away and nobody else tends to the land, I would just think of it as "test driving" the land since you are interested in buying it. Then again, it could turn into a "hind sight" situation. Good Luck and shoot straight

Go for it. Outlawing can be fun.

I wouldn't want to get on the owner's bad side if you are hoping to acquire it down the road

That's my problem, I'm not a big fan of "hind sight" situations but every time I drive by it going to our land it's slap full of big mallards. Drive by it yesterday around 3 o'clock in the afternoon and around 80 got up and just circled it up until the point that I drove off.

80 mallards isn't enough to make me poach. 8000 I'm there until they catch me. 80 just isn't worth it.

If you steal something and you don't get caught is it still stealing?

Send me the GPS coordinates and I will let you know if the land owner minds.

I've asked around to the local farmers and they're not even sure who the people are. I'm going to go to the assessors office and figure it out one day I just havnt had time yet.

And it was at least 80 in it, and it's had water less than a month. Theres more piling in every day.

Sounds like trespassing and poaching to me. How is this even a question?

Because it's only wrong if you get caught.

You could also look at it as a sanctuary for the birds, a place they will rest at. Eventually when they get up you can pull a few in. Thats a tough call. Christmas Eve would be a good time to wander over there if your going that route, the game wardens are all home

You need to go down to the tax assessor's office and then the clerk of court to determine where these people live. Contact them and get a lease on it. Who knows, you might make the inroads to actually purchase the tract since you indicated that is your ultimate goal.

I agree. This is the safest bet. They also might not mind him hunting it if he just contacts them and asks.
