Welcome to business management. Substitutions is a legitimate part of the business world.

Don't want to pay $6 for Cheerios? Pay $4 for Circle-O's. Don't want to spend $10 on Claritin? Spend $5 on Walitin. Don't want to spend $80k on a BMW? Spend $40k on a Hyundai Genesis.

Shall I go on? It's the way of the world. Permanent patents frick up the natural ebb and flow of industries. Apple has been successful despite any substitutions because they marketed their brand successfully and developed cult like loyalty. They are either beginning to struggle or are getting greedy. I imagine it's both.

Remember when Apple was going to allow a Mac clone and then pulled the plug on them at the last minute?

Apple uses smart marketing to lead to a perception of superiority but their products are always slower and more restrictive than their counterparts.

And again, if anything GE is ripping off Samsung.

If your certain, I would love to hear the evidence.

Also, the price of an object is immaterial. Price is only what consumers are willing to pay, it has no basis on the ability to copy said product or anything about the product at all besides how important society sees the product.

So really, we should be wondering why anyone gives a frick over $200 items.

That device is clearly from the future and in a time where Apple has decided (innovating of course) that color is no longer necessary and then that "Palm" company or whatever copied it.

Let's ignore the arguments posited that poke holes in the theory that Apple is the one and only innovator in the smart phone industry. Let's say they are the epitome of invention, and all others simply copy their remarkable achievements.

How is this bad to anyone but Apple? They are effectively trying to use the courts to eliminate substitutes, use the courts to eliminate the threat of new entrants to the market, decrease buyer power, and significantly reduce the motivation for more innovation.

Sounds like a great environment for only one participant of the market, themselves. No thanks. As a consumer, I prefer competition.

Right, because whether you're spending $200 or $30,000 is irrelevant to an OT baller consumer. Likewise a manufacturer doesn't distinguish the risk between a $200 product and a $30,000 product.

Seriously though--how do you see allowing copying as an incentive for innovation? You allow copying you have one company innovate and 5 copy it (like Samsung is doing very successfully).

On the other hand you frown on copying you have 6 companies innovating and more choice for the consumer. Like Microsoft, their phone OS may not be selling worth a chit but it is certainly innovative and different.

You mentioned the price as if it mattered when it comes to copying a product. As if it was material to the discussion of what could be or not be copied effectively. Don't change the argument to "win" it.

So why does apple get to sue, but Cheerios can't sue generic cereal makers making "circle o's" that look and almost taste identical? Why hasn't Walmart gotten sued for "Dr. Thunder" which uses the same doctor monicker, same colored can, and tries to replicate the taste of Dr. Pepper?
