Lawsuit filed in "Alabama Teabagging" Incident

I just thought the Rant might be interested to learn that a lawsuit has been filed in New Orleans over the incident. SIAP. Here is the summary from CNS New Orleans:

Brian Downing; The Krystal Company; Big Easy Enterprises LLC
5/3/2012 2012-04403 A
(New Orleans)

Lawsuit for premises liability and battery. In January, the plaintiff was at the Krystal Burger restaurant on Bourbon Street and was incapacitated. While he was incapacitated, defendant Downing exposed his genitals and engaged in a number of lewd acts, including touching the plaintiff with his genitals and simulating sex acts upon plaintiff while touching plaintiff with his exposed genitals, also known as "tea bagging." Then Downing posted a video of the incident on YouTube. The employees at Krystal Company ignored the incident.

I hate lawyers.

How is it the place of business fault? if the defendant cant control his drinking why should the place of business be responsible for his well being.

Now the LSU fan looks like a pansey.


Just sew the tbagger and be done with it.

Partially true. The guy shouldn't have been passed out in there but the employees shouldn't have just stood around watching while a dude whips his junk out in the middle of the restaurant either. I'm not sure if that's worth a lawsuit though.

How is it the lawyer's fault? In a post decrying the lack of personal responsibility, you don't blame the guy who is filing the suit -- the Plaintiff. If the victim doesn't want to sue, there is no lawsuit. Let's stop blaming other people for our own actions -- the guy wanted to sue, and he found a solvent defendant.
