I thought this would be the best board to ask this on. Someone has been parking on the street in front of my house daily for the last 2 weeks. I live near Catholic High so I assume it is a student. They park on the road with two tires in my front yard. It has begun to annoy me more and more as I have to look around their vehicle as I back into the road. This is not a neighborhood where it is common to park on the street. I'm concerned that if something happens this vehicle I will have some liability. What are my options? Can I call a tow truck? Will the owner be able to claim some sort of common ground? Some days their tires are not in my yard, in which case they are just parked in the middle of the road.

I'd put a note on his window asking him not to park there anymore. If that doesn't work, maybe check the rules of your HOA if you have one.

This.

Also, if it's a CHS student, then go to the school and tell them that someone's been parking in your yard. They have a record of all student's license plates. If you can match it up then problem solved. If the school has no record of the license plate, then have them call over the PA with a description of the vehicle.

Worse case scenario, call a tow truck.

start parking your car there. He can't park in your driveway

Put a note saying that he can park there if he pays you 50 bucks a week. Might be a rich kid.

for the most part, the shoulder of a road is a public thing, subject to common use.

If it is on the main road of a neighborhood, right? Because if it was a side street that's owned by the HOA. At least that is how it is in my neighborhood.

most neighborhoods transfer ownership. If this is the area I'm thinking of, it's definitely not owned by an HOA.

If he is on your yard, leave a note.
Otherwise you can't tell him he can't park on a public street.

Forgot to say if it stays parked there for days (I'm not sure what the law requires) then I think you can have it towed, but not if it is coming and going regularly.

This would be my advice.

If it's a public roadway and parking is not prohibited, he has as much right as anyone else to park there. You don't own the road in front of your house. If he's parking on your grass it's a different story. Call the cops and if you can get them to come out, they'll issue a parking violation.

I once had an SOB park blocking my driveway when I lived downtown and two people couldn't get their cars out. After 20 minutes of trying to track him down, I let the air out of all four of his tires.

Not sure if that helped the problem, but at least you got out your frustration.

If there is a sidewalk and he is parked between the sidewalk and the street, you can't have the car moved. That is considered city property. I had a neighbor park this way in front of my house and when I called the police, they told me as this. I then called the parish and asked them and they told me the same thing. I live in Jeff Parish though.

The vehicle is sometimes in my grass and sometimes just on the street. There is no sidewalk, and This isn't a street that has a shoulder for parking. When the vehicle is in the street and not in my yard he is literally just parked in the lane where cars are trying to drive.

I will try leaving a note tomorrow.

Yes, if one tire is setting on your property you can have it towed, there will be no cost or liabilty to you. I own part of a wrecker and towing company in another city.
