Insurance (Alfa) screwed me

A little over a month ago, I traded in my truck for a car. Almost weeks after that, I was hit. The major problem, is that I had not transferred insurance over to the new car yet (Holidays/Thanksgiving week and procrastination).

Called Alfa, they said that it was okay, and that I had 30 days automatic insurance because i traded in my last vehicle. I went to a local office about a week later to get a letter typed, saying that I had insurance, so I wouldnt have to pay the ticket I got for not having proof at the time of the accident.

That night, I get a call from the adjuster. He says that they may have overlooked something in the policy and that they dont know if im covered or not. Sure enough, next morning I get a call saying im not.

The reason being, the truck was in my name and my parents name, the car is in mine. They say that because of that, they dont have to cover the damages. I say its bullshite.

Im looking at $2500 to fix my car's side door, quarter panel and drivers side door, and shes claiming it will take $1500 to fix her bumper.

Im gonna guess that Alfa is going to frick me over again, and not pay for her damages. Should I go ahead and pay for her car, and possibly refinance my loan to get the money to fix mine, or should i take this to court?

I heard there is a insurance review board, is this true? How can i find out/contact them?

Whats a good insurance company to go with?


Any help or actual advice is appreciated.

FWIW, it sounds to me like you bought your car from a shitty dealership. I worked at a Nissan dealership and anytime we sold a car we would call their insurance company and let them know to change over the policies.

Your liability insurance covers you, not the car, so there should be no question about covering the other party's losses.

Check the wording on your policy regarding transfer of coverage to a replacement vehicle. The ownership of the vehicle shouldn't be a factor. Get a lawyer to write them a letter and they'll fold like a cheap suit. The lawyer shouldn't charge you more than a hundred bucks.

Crappy deal but ultimatley you didn't have insurance on a new car... that's crazy.

When I have bought cars, I don't drive them off the lot without my insurance agent getting them insured. While you can be upset with the insurance company you should be upset with yourself also.

This isn't the norm though, you have 15-30 days "grace period" usually. What if you bought a car at night, on the weekend, ect.

I agree with the thought that you are the one insured, but I could be wrong on this. The reason I always thought this was, if I were to total my buddies car or something while driving his drunk arse home from a bar or something, my insurance would cover that. Right?

if someone hit you, why are YOU paying for the damages?

They say its my fault, yet everyone I explain my situation to says its her's. I dont know who to believe at this point.

The way the accident happened...

It was raining, I was pulling out onto a 4 lane trying to get to the median, so I could turn and head south. Right when I got to the median, She hit me. I remember seeing her vehicle briefly, and it was headed north in the outside lane. Im assuming that she changed lanes and veered into me. They say its my fault because I pulled out in front of her, I say shes at fault for switching lanes and driving in the rain with no head lights on, but Im not gonna bet money going to court on that.

Thats a relief. It was gonna take literally every last dollar I had (including my tuition money).

Do you by any chance no longer live with your parents and not in school? Since your Dad is not an owner of the new vehicle and IF you are no longer in his household, it may be an issue of YOU not being covered.

You went through all that trouble. Why didn't you just change the insurance over? It's amazing how many people have gotten into wrecks on the website during this insurance "grace period."

So you were entering the roadway and then were struck by a vehicle already traveling on the roadway? Sounds like you're at fault.

I was hit in the median. I can argue that she was driving in the rain with no head lights on.

hope it works out for you...

when its your money, and you realize that your money depends on others people's driving ability...

make the phone call... before you drive it off the lot.

While I'm waiting for the finance dude to input all his data to create those 10 things to sign... Call the insurance company (as you now know, the ph number is on your insurance card)... done deal.

cause I'm the WORST at procrastinating. Now or never on some things!

i hate to say this, but it sounds like your fault. it doesn't matter if the other driver changed lanes. you have to yield to them and anticipate that they might change lanes.

slightly different example: friend of mine pulled out from the 'beach' on stanford right after sunset and was hit by a car without headlights. the cop ticketed my friend for failure to yield and put him at fault b/c failure to yield is a bigger issue than driving without headlights.

Yeah...I know im at fault. Im just hoping that the lawyer will work over Alfa into covering her damages atleast. My car looks like shite, but atleast it runs (after I put $400 in to fix the axel).

The principle behind it, is that my parents have been with Alfa for 26 years, 3 vehicles and a house, yet they wont acknowledge that as a legitimate arguement. Not surprising, insurance companies have never and will never do "the right thing."

You mean the truck I traded in? Yeah, my new car is worth more. I had full coverage on the truck though.

I understand that you're not happy, but basically you're saying that the "right thing" for the insurance company to do is to afford you the same coverage on a more valuable vehicle that is now registered in a different name than the original vehicle?

Like most companies, they're in the money business. You give them the "right" amount of money, they take the risk.

You changed the situation and didn't alert them, much less compensate them for the added risk but you want them to step up and do the "right thing"?

I wish you weren't in this position, but to me, the correct mental process is to be pissed at yourself. No reason to be pissed at them.

If somehow you they opt to compensate you somewhat, imo, you should just be thankful.

You are lucky no one was injured. Fixing the vehicles will be one of life's small problems.
