Just saw they are in talks with Big East for when Big 12 imploded. Now my question is, could A&M counter-sue both of these schools just to be dicks since they are going after TAMU?

Well, since there's no lawsuit at all right now, it would just be a suit. But if Baylor does sue A&M, I'm sure A&M will countersue (why wouldn't you?), and then I'm sure Baylor will claim this conversation is them attempting to mitigate their damages due to A&M's breach.

Where did you see this? If this is true it would nulify any argument Baylor has against A&M

This is what I thought. How can you file suit against someone for trying to better theirself, but at the same time you are looking to keep your school relevant by reaching out to another BCS conference. They would lose all grounds of their suit.

No, it wouldn't.

Baylor's argument is that A&M has already breached the agreement. Now, due to A&M's breach, Baylor is forced to mitigate its damages caused by A&M's breach. This does not, in any way, change Baylor's breach of contract argument. If they get in the Big East, it does go to their damages argument. A&M can say, "even if we did breach, how is Baylor harmed?"

Baylor finding a BCS home would be great for A&M.

Well i won't argue with your knowledge of Contract law. I am speaking from a place of opinion and ignorance of the legal profession.

However, it does seem to me to work in A&M's advantage and it makes Baylor look even more like a weasel in this deal.

Why do you think Pitt and Syracuse are leaving? Do you think they wanted to be in a conference with TCU, Baylor and Iowa State?

Baylor getting in the Big East absolutely works in A&M's favor, but not from a breach standpoint. If I'm A&M, I'm hoping the Big East takes Baylor, just because that removes the legal threat and ends the SEC drama. You'll get the waiver, in that scenario. Baylor getting to the Big East also helps Texas, but not as much.

If Baylor and TCU end up in the same conference, that would be very funny.

Dear Big East,

We would like to join your conference. We have a good women's basketball program, a shitty town, and we are hardcore Baptists. We love to eat at Luby's on Sunday and don't like drinking or dancing. We are also very litigious and get discount tours of the Dr. Pepper headquarters. Just imagine the Big East having access to the Waco TV market. We could be unstoppable together.

Blessings,

Baylor
