I know 2nd degree battery is a felong and simple battery is a misdemeanor. In looking at the law I can't tell what the police use apply a 2nd degree battery charge vs. a simple battery charge. What is the difference.

Pretty simple rule of thumb is that if the victim went to the hospital and received medical treatment, was knocked unconscious, or had any broken bones then its 2nd degree battery

Shouldn't we be blaming Moffit for all of this then?

Second degree battery is when the act results in very serious injuries, impairment, disfigurement, perhaps when one is left unconscious. Its when the injuries exceed the normal busted nose, or knot on the head. Its when medical attention is required for a serious injury.

According to the BRPD statement, the victims received "scrapes and cuts".

Sounds more like simple battery to me.

It's better to use them and then recharge them. It's kinda like letting them flex their muscles. If you constantly keep them in the charger, over time they won't hold a charge that long. Hope this helps. thanks.

It doesn't matter, since the police refused to question the suspects to get their side of the story.

obviously, the police do not want to arrest football players, so if the "victims" refuse to drop charges. it will be a botched case. they won't risk hillar Moore going for a felony.

Did the police pay the suspects a visit, to try to get their side of the story? yes, or no?

Willful ignorance is no excuse.

Lawyer for LSU players postpones meeting with police

Jeff Palermo / Jay Vise Reporting
An attorney for the LSU players says a planned meeting with the police department on Monday has been postponed "indefinately."

Nathan Fisher, a lawyer who has in the past represented other LSU players, tells WWL First News that he just received the case today.

The Baton Rouge Police Department had requested that quarterback Jordan Jefferson, offensive lineman Chris Davenport, linebacker Josh Johns and wide receiver Jarvis Landry meet with detectives Monday Morning to give their side of the story.

Police Spokesman Sgt. Don Stone says that meeting is now scheduled for Tuesday morning.

Once the alleged victims said they wanted to press charges, the suspects should have been questioned. period.

whether or not the suspects want to answer questions/tell the truth is on them. I don't think the police should have made it so clear that they are not interested.

I am not outraged by the fighting. it's just the political way it's handled that disgusts me. I know louisianians love that shite, but I don't.

Shouldn't the real question be, breaking and entering? Even the police have to have a warrant to enter your vehicle. What kind of crime is it to physically enter someones vehicle and drag them out?
