Is it legal to transport an open container in the trunk?



Say I wanted to keep unused booze after a party, how would I legally get that home?

If you want to make it a legal closed container, put tape across the top of the cork/top in an X shape, then put a piece of tape around where the cork/top meets the bottle. That makes it a legally closed container.

My wife and I own a place where we sell wine by the bottle, and that's how the state responsible vendors told us to "recork" the bottles. Cork or screw cap makes no difference.

Well, why would the police officer search your trunk? He would have no probable cause to unless you were drunk and had probably cause to search the car. If you're not drunk, have nothing in the main car, and he has no PC, then he can't search the trunk lawfully.

So, maybe you technically can't (i actually don't know. probably is state by state in the statutes), but it doesn't really matter.

Also, there's most likely some sort of exception to the general rule of open containers which allow for you not to be in violation if it's not within arm's reach, i.e., the trunk.

This might be the law, but I was pulled over in St. James Parish when a sherrif noticed my expired inspection sticker. He first asked if I had any firearms in my vehicle, which I did not and then asked if he could look around. I had no reason to say no, but just what would have happend if I had accidentally had an old empty bottle under the seat? Did he have cause to search and find? No, but he found.....Now the legal process ($$$) has to take place to remove the charge, right?

Wait, so you allowed him to search? If so, he found the empty container? I guess I'm not following you.

If you didn't allow him to search and he looked in your vehicle and saw the container in plain view, then he could go in a "reasonably" search the vehicle.
